                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     costs.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Subsection (b) of section 1725.1 of Title 42, act
     7  of November 25, 1970 (P.L.707, No.230), known as the
     8  Pennsylvania Consolidated Statutes, amended July 10, 1980
     9  (No.106), is amended to read:
    10  § 1725.1.  Costs.

    12     (b)  Criminal cases.--
    13         (1)  The costs to be charged by the minor judiciary or by
    14     the court of common pleas where appropriate in every criminal
    15     case, except as otherwise provided in this section, shall be
    16     as follows:
    17             [(1)] (i)  Summary conviction, except motor vehicle
    18         cases ............................................ $16.00

     1             [(2)] (ii)  Summary conviction, motor vehicles cases,
     2         other than [paragraph (3)] subparagraph (iii).... $10.00
     3             [(3)] (iii)  Summary conviction, motor vehicle cases,
     4         hearing demanded ................................. $15.00
     5             [(4)] (iv)  Misdemeanor ...................... $20.00
     6             [(5)] (v)  Felony ............................ $25.00
     7         (2)  Such costs shall include all charges including the
     8     costs of giving a district justice's transcript to the
     9     prosecutor or defendant, or both, if requested. Such costs
    10     shall not include, however, the cost of postage and
    11     registered mail which shall be paid by the defendant upon
    12     conviction.
    13         (3)  In those criminal cases where the defendant has been
    14     assessed costs and has paid such costs and is later found not
    15     guilty or is otherwise exonerated from criminal liability for
    16     the charges, the defendant shall be reimbursed by the county
    17     and the Commonwealth for the costs paid. The county and the
    18     Commonwealth shall each reimburse the defendant that portion
    19     of the costs paid over to it originally.
