                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, requiring lighted headlights when it is raining and
     3     providing for the tarpaulins or other covers on certain
     4     loads.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 4302 of Title 75, act of November 25,
     8  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     9  Statutes, is amended to read:
    10  § 4302.  Period for requiring lighted lamps.
    11     Every vehicle upon a highway at any time between sunset and
    12  sunrise, during periods of rain and at any other time when, due
    13  to insufficient light or unfavorable atmospheric conditions,
    14  persons and vehicles on the highway are not clearly discernible
    15  from a distance of 1000 feet ahead shall display lighted head
    16  and other lamps and illuminating devices as required under this
    17  chapter for different classes of vehicles, subject to exceptions
    18  with respect to parked vehicles. Stop lights, turn signals and


     1  other signaling devices shall be lighted as prescribed in this
     2  title.
     3     Section 2.  Section 4903 of Title 75 is amended by adding a
     4  subsection to read:
     5  § 4903.  Securing loads in vehicles.
     6     * * *
     7     (c.1)  Tarpaulin or other cover required.--Any vehicle while
     8  hauling loads of coal, sand, cinders, gravel, stones, leaves,
     9  dirt or other loose materials shall have a tarpaulin or other
    10  adequate and suitable cover over the material which shall
    11  prevent its dropping, spilling, sifting, blowing or otherwise
    12  escaping upon the highway. The driver and registrant of any
    13  vehicle that deposits such material on the highway shall be
    14  responsible for removing the same.
    15     Section 3.  This act shall take effect in 60 days.
