                                  A SUPPLEMENT

     1  To the act of November 30, 1965 (P.L.843, No.355), entitled "An
     2     act providing for the establishment and operation of Temple
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related university in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; providing for public support and capital
    10     improvements; authorizing appropriations in amounts to be
    11     fixed annually by the General Assembly; providing for the
    12     auditing of accounts of expenditures from said
    13     appropriations; authorizing the issuance of bonds exempt from
    14     taxation within the Commonwealth; requiring the President to
    15     make an annual report of the operations of Temple
    16     University," making appropriations for carrying the same into
    17     effect, providing for a basis for payments of such
    18     appropriation and providing a method of accounting for the
    19     funds appropriated.

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  The following sums, or as much thereof as may be
    23  necessary, are hereby specifically appropriated to the Trustees
    24  of Temple University at Philadelphia for the fiscal year July 1,
    25  1980 to June 30, 1981, for the purposes and in the amounts as
    26  shown:

     1     (1)  For educational and general expenses.....    $67,867,000
     2     (2)  For cost of student aid..................      3,018,000
     3     (3)  For instruction - Doctor of Medicine
     4          only.....................................      5,412,000
     5     (4)  For operation of dental clinics in the
     6          school of dentistry......................        600,000
     7     (5)  Temple University Hospital...............      2,500,000
     8     Section 2.  Payments to Temple University on account of the
     9  appropriations for all items, as provided in section 1, except
    10  for instruction Doctor of Medicine, shall be made on the basis
    11  of costs during the fiscal year.
    12     Payments for instruction - Doctor of Medicine only shall be
    13  made on the basis of full-time students enrolled at the rate of
    14  $7,465 per student.
    15     Section 3.  If necessary, Temple University may transfer
    16  funds among the appropriations listed in section 1, clauses (1)
    17  and (2): Provided, That the aggregate amount transferred into or
    18  out of each appropriation during the fiscal year shall not
    19  exceed 5% of the amount specifically appropriated for that
    20  purpose.
    21     Section 4.  Payment to Temple University of the
    22  appropriations herein provided shall be made monthly during the
    23  fiscal year.
    24     Such monthly payments shall be made in accordance with the
    25  provisions of sections 2 and 3, on the basis of estimated costs
    26  and full-time students enrolled in the Doctor of Medicine
    27  program. The estimate of costs shall be submitted by Temple
    28  University to the Secretary of Education, the General Assembly
    29  and to the State Treasurer not later than 30 days prior to the
    30  date on which such payment is to be made.

     1     Section 5.  Temple University shall apply the moneys
     2  appropriated by this act only for such purposes as are permitted
     3  in this act and shall at all times maintain proper records
     4  showing the application of such moneys. Not later than 120 days
     5  after the close of the fiscal year to which this act relates,
     6  Temple University shall file with the Secretary of Education,
     7  the General Assembly and with the Auditor General of the
     8  Commonwealth a statement setting forth the amounts and purposes
     9  of all expenditures made from moneys appropriated by this act
    10  and other university accounts during said fiscal year the number
    11  of full-time students enrolled in the Doctor of Medicine program
    12  and costs, as provided in section 2, used as a basis for receipt
    13  of any appropriation during said fiscal year. Such statement of
    14  expenditures, and number of full-time students enrolled in the
    15  Doctor of Medicine program and costs shall be reviewed by the
    16  Auditor General of the Commonwealth, and he shall have the
    17  right, in respect to the moneys appropriated by this act, to
    18  audit and disallow expenditures made for purposes not permitted
    19  by this act and to cause such sums to be recovered and paid by
    20  Temple University to the Treasurer of the Commonwealth. The
    21  Auditor General shall also make a determination of full-time
    22  students enrolled in the Doctor of Medicine program and costs
    23  and make certification as to their correctness. In respect to
    24  expenditures made by the university from moneys other than those
    25  appropriated by this act, the Auditor General shall have the
    26  right to review only and he shall file annually with the General
    27  Assembly such information concerning said expenditures as the
    28  General Assembly or any of its committees may require.
    29     Section 6.  A report shall be submitted to the Governor and
    30  the Appropriations and Education Committees of the Senate and

     1  House of Representatives and shall include data for all programs
     2  except the Doctor of Medicine program. Each such report, to be
     3  submitted prior to October 1, 1981, shall cover the 12-month
     4  period beginning September 1, 1980 and shall include for each
     5  term during the period:
     6     (1)  The following counts and distributions:
     7     (i)  The definitions and numbers of faculty members, employed
     8  full-time, of faculty members employed part-time, of full-time
     9  students enrolled in graduate courses, of full-time students
    10  enrolled in undergraduate courses, of part-time students
    11  enrolled in graduate courses, and of part-time students enrolled
    12  in undergraduate courses.
    13     (ii)  A distribution of faculty members employed part-time by
    14  the percentage of full-time employment.
    15     (iii)  Total numbers of undergraduate student credit hours,
    16  divided into lower division and upper division course levels,
    17  and of graduate student credit hours divided into three course
    18  levels--master's, first professional and doctoral.
    19     (iv)  Number of different courses scheduled by level of
    20  instruction, and the number of students receiving individual
    21  instruction at each level of instruction.
    22     (v)  Number of terms scheduled and the dates thereof.
    23     (2)  Two classifications: one, a classification of faculty
    24  members or other professional employees by title including:
    25  professor, associate professor, assistant professor, instructor,
    26  lecturer, research associate, librarian, and academic
    27  administrator; faculty members or other professional employees
    28  under each title to be subdivided by type of assignment:
    29  instructional or noninstructional divided into teaching and
    30  nonteaching, and each such set of faculty members or other

     1  professional employees to be further subdivided by type of
     2  employment: full-time or part-time; and two, a classification of
     3  faculty members and other professional employees by school and
     4  department to be subdivided by type of assignment: instructional
     5  or noninstructional divided into teaching and nonteaching, and
     6  each such set of faculty members or other professional employees
     7  to be further subdivided by type of employment: full-time or
     8  part-time; and the following aggregates for each subdivision in
     9  each classification:
    10     (i)  The number.
    11     (ii)  The sum of credits assigned to undergraduate classroom
    12  courses and the sum of credits assigned to graduate classroom
    13  courses taught, divided into lower division, upper division,
    14  master's, first professional and doctoral course levels.
    15     (iii)  The sum of undergraduate classroom student credit
    16  hours and the sum of graduate classroom student credit hours
    17  generated; divided into lower division, upper division,
    18  master's, first professional and doctoral course levels.
    19     (iv)  The sum of undergraduate individual instruction student
    20  credit hours and the sum of graduate individual instruction
    21  student credit hours generated; divided into lower division,
    22  upper division, master's, first professional and doctoral course
    23  levels.
    24     (v)  Total salary paid.
    25     (vi)  Total salary paid from college or university funds.
    26     (vii)  Total salary paid from Federal funds.
    27     (viii)  Total salary paid from other funds.
    28     (3)  For each term of the period covered for each faculty
    29  member employed full-time identified by school, department and
    30  title:

     1     An analysis of the average hours per week spent in college or
     2  university-related activities, stating specifically hours spent
     3  in undergraduate classroom contact and graduate classroom
     4  contact, hours spent in preparation, hours spent in research and
     5  hours spent in public service.
     6     Section 7.  In addition to the above requirements relative to
     7  this appropriation, each report covering the 12-month period
     8  beginning September 1, 1980, shall include for all programs of
     9  the university:
    10     (1)  Minimum number of credits required for a baccalaureate
    11  degree and for a master's degree.
    12     (2)  Number of bachelor's degrees, master's degrees, first
    13  professional degrees, and doctoral degrees awarded in 1978,
    14  1979, 1980 and estimated 1981.
    15     The university shall report its revenues and expenditures and
    16  present its financial statements required under the provisions
    17  of this act in accordance with "Higher Education Finance Manual"
    18  (1975).
    19     Section 8.  The university shall provide such information as
    20  may be necessary to carry out this act and in such form and
    21  manner as the Department of Education may prescribe.
    22     Section 9.  The university shall report its revenues and
    23  expenditures and present its financial statements required under
    24  the provisions of this act in accordance with generally accepted
    25  accounting principles and procedures for educational
    26  institutions as set forth in "Higher Education Finance Manual"
    27  United States Department of Health, Education and Welfare (1975)
    28  with the exceptions set forth in the Commonwealth of
    29  Pennsylvania Budget Instructions for State Related Universities,
    30  Phase I, Fiscal Year 1980-1981. Credits granted for

     1  nontraditional programs such as CLEP, lifelong learning etc.,
     2  including all related costs and revenues thereof shall be
     3  excluded from the function of "Instruction" and included under
     4  "Public Service."
     5     Section 10.  This act shall take effect July 1, 1980.
