                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for theft and
     3     vandalism of fire, emergency and life saving equipment.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3305 of Title 18, act of November 25,
     7  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     8  Statutes, is amended to read:
     9  § 3305.  Injuring or tampering with fire apparatus, hydrants,
    10           emergency equipment, etc.
    11     Whoever willfully and maliciously cuts, injures, damages, or
    12  destroys or defaces any fire hydrant or any fire hose or fire
    13  engine, or other public or private fire equipment, or any
    14  apparatus appertaining to the same, or emergency equipment,
    15  including fire and rescue and lifesaving equipment, commits a
    16  [misdemeanor of the third degree] felony of the first degree.
    17     Section 2.  Title 18 of the act is amended by adding a
    18  section to read:

     1  § 3933.  Theft of fire or emergency equipment.
     2     A person is guilty of a felony of the first degree if he
     3  unlawfully takes or exercises unlawful control over fire or
     4  emergency equipment, including fire and rescue equipment and
     5  lifesaving equipment.
     6     Section 3.  This act shall take effect in 60 days.
