AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," permitting school nurses, principals 6 and teachers to give certain medications by injection to 7 students. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 1401, act of March 10, 1949 (P.L.30, 11 No.14), known as the "Public School Code of 1949," is amended by 12 adding a clause to read: 13 Section 1401. Definitions.--As used in this article-- 14 * * * 15 (12) "Medicinal preparations" means and includes only those 16 preparations which must be administered pursuant to the written 17 order of a physician during hours that school is in session. 18 Section 2. Section 1402 of the act is amended by adding a 19 subsection to read: 20 Section 1402. Health Services.--* * *
1 (g) Each school district with the advice of the school or 2 district physician may establish specific policy and regulations 3 concerning the administration of medicinal preparations by a 4 school nurse or in the absence of such nurse, by the principal 5 or any teacher and shall submit such special policy and 6 regulations to the Department of Health for approval. 7 (1) Physician's orders for medicinal preparations to be 8 administered shall specify in writing the duration of the order, 9 name of the drug and the dose and shall be renewed each school 10 year. 11 (2) Each school wherein any medicinal preparations are 12 administered shall keep a bound book with consecutively numbered 13 pages in which shall be recorded in ink the administration of 14 medicinal preparations in each case showing: (i) the date and 15 time of administration, (ii) the name of the student to whom 16 medicinal preparation was administered, (iii) the kind and 17 quantity of medicinal preparation, (iv) the name of the 18 prescribing physician, (v) the signature of the nurse, principal 19 or teacher of the school administering the medicinal 20 preparation. 21 (3) Transactions so recorded shall not be altered. 22 (4) Such book shall constitute a record which shall be made 23 available to State Health Department representatives, and each 24 such record shall be kept in a designated place for a period of 25 two (2) years from the date of the last transaction recorded in 26 the book. 27 (5) The specific written order of the physician and the 28 written authorization of a parent or guardian shall be filed 29 with the student's cumulative health record and kept at least 30 two (2) years and according to local policy, all written 19800H2552B3351 - 2 -
1 authorizations shall be renewed each school year. 2 (6) The local regulations shall include a plan under 3 direction of the district physician for enabling persons 4 administering medicinal preparations to acquire adequate 5 knowledge and skill to safely administer such preparations. 6 (7) Not more than one (1) month's supply of a prescribed 7 medication shall be stored in a school. The prescribed medicinal 8 preparations shall be stored in a designated place securely 9 locked at all times. 10 Section 3. This act shall take effect in 60 days. A29L24RZ/19800H2552B3351 - 3 -
