AN ACT 1 Providing for the regulation of gasoline advertising. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 Section 1. The following words and phrases when used in this 5 act shall have, unless the context clearly indicates otherwise, 6 the meanings given to them in this section: 7 "Regular grade of gasoline." A grade of gasoline for which 8 the average of the Research Octane Number and the Motor Octane 9 Number ((RON + MON)/2) equals at least 89. 10 "Unleaded grade of gasoline." A grade of gasoline which has 11 .05 grams of lead per gallon or less and for which the average 12 of the Research Octane Number and the Motor Octane Number ((RON 13 + MON)/2) equals at least 87. 14 Section 2. Every person engaged in the business of selling 15 gasoline to the public shall post on the property of such 16 business, a sign or signs displaying the price per gallon then 17 being charged for its regular grade of gasoline and unleaded
1 grade of gasoline if either such grade of gasoline is being 2 offered for sale. The numerals on such signs shall be displayed 3 in such a size and style that under ordinary weather conditions, 4 they will be readily visible to an ordinary motor vehicle 5 operator approaching the station on the major road bordering the 6 gasoline station business property. The sign or signs shall 7 identify the grade of gasoline to which each figure refers. If 8 the prices displayed refer to the price charged on condition 9 that the customer operate the gasoline pump, then the sign or 10 signs displaying such prices shall bear the words "Self-Service" 11 in such a size and style that under ordinary weather conditions, 12 the words will be readily visible to an ordinary motor vehicle 13 operator approaching the station on the major road bordering the 14 gasoline station business property. 15 Section 3. Any owner or operator of such a business who 16 violates the provisions of this act shall be guilty of a summary 17 offense and, upon conviction thereof, shall, for the first 18 offense be sentenced to pay a fine not exceeding $300, and for a 19 second and each subsequent offense, be sentenced to pay a fine 20 not exceeding $1,000. 21 Section 4.
