AN ACT 1 Amending the act of February 19, 1980 (No.9), entitled "An act 2 establishing the State Real Estate Commission and providing 3 for the licensing of real estate brokers and salesmen," 4 requiring a license for persons selling cemetery lots, 5 conferring authority upon the commission relating to 6 cemeteries, and providing penalties. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The act of February 19, 1980 (No.9), known as the 10 "Real Estate Licensing Act," is amended by adding sections to 11 read: 12 Section 407. Investigation of cemetery business. 13 The commission is authorized to investigate any licensee 14 engaged in a business relating to cemetery lots, plots or 15 mausoleum spaces, openings or foundations and to suspend or 16 revoke the license in accordance with the provisions of section 17 604 if it is determined that the licensee has violated any of 18 the provisions of this act, of 9 Pa.C.S. Ch.3 (relating to the 19 regulation of cemetery companies), or the act of August 14, 1963
1 (P.L.1059, No.459), relating to future need sales for death and 2 interment. 3 Section 534. Cemeteries and mausoleums. 4 No person, firm or corporation not otherwise licensed under 5 Subchapter B shall engage in or carry on a business which in 6 whole or in part relates to cemetery lots, plots and mausoleum 7 spaces, openings or foundations without first obtaining a 8 license pursuant to this subchapter unless such cemetery is 9 owned or controlled by a bona fide fraternal organization or a 10 bona fide church or religious congregation or any association 11 created by any such church or religious congregation. Any 12 person, firm or corporation violating the provisions of this 13 section shall be subject to the penalties provided in section 14 303. 15 Section 2. This act shall take effect in 90 days.
