        AS RE-REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, SEPTEMBER 24, 1980

                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, to convey to the Borough
     3     of Mahaffey, 2.7956 acres of land, more or less, situate in
     4     the Borough of Mahaffey, Clearfield County, Commonwealth of
     5     Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Governor, is hereby authorized and directed on
    10  behalf of the Commonwealth of Pennsylvania, to grant and convey
    11  to the Borough of Mahaffey the following tract of land situate
    12  in the Borough of Mahaffey, Clearfield County, and Commonwealth
    13  of Pennsylvania, bounded and described as follows:
    14     BEGINNING at an iron pin in the centerline of the right-of-
    15  way of Conrail Corporation, said point being south 10 degrees 44
    16  minutes east, 239.96 feet from a point in the centerline of
    17  Pennsylvania Highway Route No.36, 31.5 feet east of the


     1  centerline of Pine Street; thence by other lands of Conrail
     2  Corporation, south 10 degrees 44 minutes east, 440.00 feet to an
     3  iron pin on top of the bank of the West Branch of the
     4  Susquehanna River; thence downstream north 76 degrees 33 minutes
     5  east, 282.64 feet to a pipe; thence by land now or formerly of
     6  Harrie Hall north 44 degrees 35 minutes west, 176.00 feet to an
     7  iron pin; thence by said Hall land and land now or formerly of
     8  Mott north 43 degrees 06 minutes 21 seconds east, 285.23 feet to
     9  a post; thence by a 0.0343 acre lot of land of Mahaffey Borough,
    10  north 44 degrees 35 minutes west, 65.00 feet to the right-of-way
    11  line of Conrail Corporation; thence by same north 85 degrees 04
    12  minutes west, 129.23 feet to the south right-of-way line of
    13  Conrail Corporation, 33 feet from the centerline thereof; thence
    14  by said right-of-way line south 84 degrees 30 minutes west,
    15  255.00 feet to the point of beginning. Containing 2.7956 acres.
    16     The conveyance shall  be made under and subject to all
    17  easements, servitudes and rights of others, including but not
    18  confined to streets, roadways and rights of any telephone,
    19  telegraph, water, electric, sewer, gas or pipeline companies, as
    20  well as under and subject to any interest, estates or tenancies
    21  vested in third persons, whether or not appearing of record, for
    22  any portion of the land or improvements erected thereon.
    23     Section 2.  The Deed of Conveyance shall contain a clause
    24  that the lands conveyed shall be used for a mini-park by the
    25  Borough of Mahaffey and if at any time the said Borough of
    26  Mahaffey or its successor in function conveys said property or
    27  permits said property to be used for any purpose other than
    28  those aforementioned, the title thereto shall immediately revert
    29  to and revest in the Commonwealth of Pennsylvania.
    30     Section 3.  The Deed of Conveyance shall  be approved by the

     1  Department of Justice and shall be executed by the Secretary of
     2  General Services in the name of the Commonwealth of
     3  Pennsylvania.
     4     SECTION 4.  ALL COSTS AND FEES INCIDENTAL TO THIS CONVEYANCE   <--
     5  SHALL BE BORNE BY THE GRANTEE.
     6     Section 4 5.  This act shall take effect immediately.          <--
