AN ACT 1 Amending the act of June 3, 1937 (P.L.1225, No.316), entitled 2 "An act concerning game and other wild birds and wild 3 animals; and amending, revising, consolidating, and changing 4 the law relating thereto," providing for migratory waterfowl 5 stamps. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The act of June 3, 1937 (P.L.1225, No.316), known 9 as "The Game Law," is amended by adding a section to read: 10 Section 503.1. Waterfowl Stamp.--(a) As used in this 11 section, the term "migratory waterfowl" shall mean a wild goose, 12 brant or wild duck. 13 (b) No person may hunt or take any migratory waterfowl 14 within the Commonwealth without first procuring a migratory 15 waterfowl stamp as provided herein. Such stamp must be in the 16 possession of every person when hunting or taking any migratory 17 waterfowl. Each stamp shall be validated by the signature of the 18 licensee written across the face of such stamp. The stamp shall
1 be designed and produced in accordance with departmental 2 regulations and shall expire annually on the same date each year 3 that all hunting licenses expire. 4 (c) A stamp shall be issued to each hunting license 5 applicant upon written request on the forms furnished by the 6 department and the payment of an additional fee of three dollars 7 ($3.00). 8 (d) All funds derived from the issuance of migratory 9 waterfowl stamps shall be deposited by the department with the 10 State Treasurer and shall be credited to the Game Fund. 11 (e) Fifty percent (50%) of the revenue collected pursuant to 12 this section shall be used for the purpose of protection, 13 preserving, restoring, enhancing and developing waterfowl 14 habitat in the Commonwealth. 15 (f) The remaining fifty percent (50%) of the revenue 16 collected pursuant to this section shall be used by the 17 commission in cooperation with an appropriate nonprofit 18 organization for the purpose of development of waterfowl 19 propagation areas in Canada from which come substantial numbers 20 of waterfowl migrating to and through the Commonwealth. 21 (g) The department shall, by regulation, establish a method 22 of selecting appropriate designs for the migratory waterfowl 23 stamp. 24 Section 2. This act shall take effect immediately and shall 25 apply to hunting license years commencing on and after September 26 1, 1981. K28L29DS/19790H2077B2624 - 2 -
