AN ACT
1 Creating the Recreation Fund in the State Treasury, authorizing
2 low interest loans from the fund to municipalities for the
3 purpose of building recreation centers, and making an
4 appropriation from the State Lottery Fund.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Establishment of fund.
8 There is hereby established in the State Treasury, a fund
9 separate and apart from all other public moneys of the
10 Commonwealth, to be known as the "Recreation Fund."
11 Section 2. Purpose and administration of fund.
12 The Department of Community Affairs shall administer the fund
13 and shall have the authority to make loans to municipalities for
14 the purpose of the construction of recreation centers. Loans
15 made by the department shall be at interest rates below that of
16 commercial rates.
17 Section 3. Powers and duties of the department.
18 The department, in carrying out the purposes of this act, is
1 authorized to accept mortgages on any recreation center and to
2 sell, transfer, convey or assign any such mortgage. Any moneys
3 derived from the sale of any such mortgage shall be deposited by
4 the department in the Recreation Fund. The department shall have
5 no power at any time to pledge the credit or taxing power of the
6 Commonwealth or any of its municipalities.
7 Section 4. Subject of loan.
8 The recreation centers for which loans may be made shall
9 include the building and the land upon which it is located, but
10 shall not include furniture or fixtures.
11 Section 5. Loan application requirements.
12 Prior to the loaning of any funds to a municipality for the
13 construction of a recreation center, the department shall
14 receive from the municipality a loan application containing the
15 following minimum provisions:
16 (1) A general description of the recreation center
17 project.
18 (2) A legal description of the real estate related to
19 the project and a statement of value of such property.
20 (3) Such plans, blueprints, drawings and other documents
21 as may be required to show the type, structure and general
22 character of the recreation center building and grounds.
23 (4) A general description of the municipality which it
24 shall serve. This shall include a general description of the
25 population group which the center would be expected to serve.
26 (5) The cost or estimate of cost of construction.
27 (6) A statement of cash funds previously applied for or
28 currently being held by the municipality which are available
29 for and are to be applied to the recreation center.
30 (7) A statement outlining the financing of all the costs

1 of the center, including furniture, fixtures and salaries.
2 (8) Such other information as the department may
3 require.
4 Section 6. Appropriation.
5 The sum of $l0,000,000, or as much thereof as may be
6 necessary, is hereby appropriated from the State Lottery Fund to
7 the Recreation Fund for the purposes of this act.
8 Section 7. Effective date.
9 This act shall take effect July 1, 1981.
