AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, providing for arrests on <-- 3 boundary roads FURTHER PROVIDING FOR CERTAIN ARRESTS. <-- 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. SECTION 8901 OF Title 42, act of November 25, <-- 7 1970 (P.L.707, No.230), known as the Pennsylvania Consolidated 8 Statutes, is amended by adding a section to read: <-- 9 § 8902. Arrests on boundary roads. <-- 10 (a) General rule.--A police officer who is not otherwise 11 authorized to act in an adjoining political subdivision may 12 arrest with or without warrant any person for a summary or other 13 offense committed by such person on or immediately adjacent to a 14 boundary road of a political subdivision in which the police 15 officer is otherwise authorized to make similar arrests. The 16 arrest may be made with the same force and effect as if it were 17 made wholly within the territorial limits of the political
1 subdivision of the arresting office. 2 (b) Definition.--As used in this section: 3 "Boundary road." A public road or highway which forms the 4 official boundary between political subdivisions. 5 § 8901. INTRASTATE HOT PURSUIT. <-- 6 ANY POLICE OFFICER OF ANY POLITICAL SUBDIVISION MAY ARREST 7 WITH OR WITHOUT WARRANT ANY PERSON BEYOND THE TERRITORIAL LIMITS 8 OF SUCH POLITICAL SUBDIVISION FOR A SUMMARY OR OTHER OFFENSE 9 COMMITTED BY SUCH PERSON WITHIN SUCH POLITICAL SUBDIVISION, OR 10 ON OR WITHIN VIEW OF THE BOUNDARY OF SUCH POLITICAL SUBDIVISION, 11 IF THE OFFICER CONTINUES IN PURSUIT OF SUCH PERSON AFTER 12 COMMISSION OF THE OFFENSE. THE POLICE OFFICER SHALL EXERCISE 13 UNDER THIS SECTION ONLY THE POWER OF ARREST WHICH HE WOULD HAVE 14 IF HE WERE ACTING WITHIN THE TERRITORIAL LIMITS OF HIS POLITICAL 15 SUBDIVISION. 16 Section 2.
