AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," providing for payments to school 6 districts to cover a portion of the costs to control or 7 eliminate the health problems posed by the presence of 8 asbestos in public schools. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. The act of March 10, 1949 (P.L.30, No.14), known 12 as the "Public School Code of 1949," is amended by adding a 13 section to read: 14 Section 2511.2. Payments for Programs to Eliminate Asbestos 15 in Public Schools.--(a) Each school district shall be entitled 16 to receive from the Department of Education payments to 17 reimburse them for fifty per centum (50%) of the costs incurred 18 in programs, approved by the Department of Education, to control 19 or eliminate the health problems posed by the presence of 20 asbestos in such schools. If the school district receives
1 Federal funds for this purpose the Commonwealth shall reimburse 2 the district for one-half of the costs incurred by the district 3 after subtracting the amount of Federal funds received from the 4 total cost of the program. 5 (b) The reimbursement of the approved costs shall be made to 6 a school district over a three year period with equal payment in 7 each year. Such payments shall be made each year at the time the 8 final payments are made to the school districts in accordance 9 with section 2517. 10 (c) School districts shall be entitled to reimbursement for 11 said costs incurred on and after January 1, 1977 if such costs 12 are approved by the department. A school district shall have two 13 years from the effective date of this amendatory act to apply 14 for reimbursement. 15 (d) The Department of Environmental Resources shall be 16 responsible for inspection and verification of all programs for 17 which reimbursement is sought. 18 Section 2. The General Assembly shall appropriate to the 19 Department of Education and the Department of Environmental 20 Resources an amount necessary to carry out the provisions of 21 this act. 22 Section 3.
