                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for a penalty for possession
     3     of a firearm during the commission of certain offenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 907 of Title 18, act of November 25, 1970
     7  (P.L.707, No.230), known as the Pennsylvania Consolidated
     8  Statutes, is amended by adding a subsection to read:
     9  § 907.  Possessing instruments of crime.

    11     (d)  Possession of a firearm during the commission of certain
    12  offenses.--A person commits a felony of the second degree, for
    13  which the minimum sentence shall in all cases be no less than
    14  one-half the maximum sentence provided by law, if he possesses a
    15  firearm while engaged in or an accomplice to the commission of,
    16  an attempt to commit, or flight after committing any crime
    17  defined by this title. As used in this subsection, "firearm"
    18  means an instrument used in the propulsion of shot, shell,

     1  bullet or any other object by the action of gunpowder exploded,
     2  explosive powder or the expansion of gas therein.
     3     Section 2.  This act shall take effect immediately.
