AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, providing for the secure 3 detention of certain dependent children. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 6351 of Title 42, act of November 25, 7 1970 (P.L.707, No.230), known as the Pennsylvania Consolidated 8 Statutes, is amended to read: 9 § 6351. Disposition of dependent child. 10 (a) General rule.--If the child is found to be a dependent 11 child the court may make any of the following orders of 12 disposition best suited to the protection and physical, mental, 13 and moral welfare of the child: 14 (1) Permit the child to remain with his parents, 15 guardian, or other custodian, subject to conditions and 16 limitations as the court prescribes, including supervision as 17 directed by the court for the protection of the child. 18 (2) Subject to conditions and limitations as the court
1 prescribes transfer temporary legal custody to any of the 2 following: 3 (i) Any individual resident within or without this 4 Commonwealth who, after study by the probation officer or 5 other person or agency designated by the court, is found 6 by the court to be qualified to receive and care for the 7 child. 8 (ii) An agency or other private organization 9 licensed or otherwise authorized by law to receive and 10 provide care for the child. 11 (iii) A public agency authorized by law to receive 12 and provide care for the child. 13 (3) Without making any of the foregoing orders transfer 14 custody of the child to the juvenile court of another state 15 if authorized by and in accordance with section 6363 16 (relating to ordering foreign supervision). 17 (b) [Limitation on confinement.--Unless a child found to be 18 dependent is found also to be delinquent he shall not be 19 committed to or confined in an institution or other facility 20 designed or operated for the benefit of delinquent children.] 21 Confinement.--The court may order a dependent child in such 22 security as may be necessary to prevent the child from harming 23 himself or any other person or from damaging any property. 24 (c) County programs.--Every county of this Commonwealth 25 shall develop programs for children under paragraph (5) or (6) 26 of the definition of "dependent child" in section 6302 (relating 27 to definitions). 28 Section 2.
