                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for nonvoting student
     6     representatives on school boards.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the "Public School Code of 1949," is amended by adding a
    11  section to read:
    12     Section 328.  Student Representatives.--(a)  In addition to
    13  the elected members, there shall be two (2) student members on
    14  each school board. The students shall act in a nonvoting
    15  capacity and represent the students in all the schools of the
    16  district.
    17     (b)  The student school board representatives shall be
    18  elected by each school's student government through their
    19  regular election procedures. In those school districts comprised


     1  of more than one senior high school, officers shall sit as a
     2  joint board for the purpose of selecting the two (2) school
     3  board representatives.
     4     (c)  The student representative shall have the following
     5  qualifications:
     6     (1)  One shall be a senior, that is any current twelfth
     7  grader in a secondary school.
     8     (2)  One shall be a junior, that is any current eleventh
     9  grader in a secondary school.
    10     (3)  Be familiar with school board procedures.
    11     (4)  Be able to express students' views intelligently in an
    12  oral manner.
    13     (d)  The term of office of the student representatives shall
    14  be one academic year. The senior, after having finishing his or
    15  her term, shall be replaced by the junior. The junior, before
    16  assuming the position as senior representative shall undergo a
    17  vote of confidence. Vacancies shall be filled for the unexpired
    18  terms in the same manner as the original members are selected.
    19     (e)  The powers and duties of student school board
    20  representative shall be:
    21     (1)  To advise their respective school boards on matters
    22  concerning student activities and concerns.
    23     (2)  To report back to the student government on all policies
    24  of concern to students.
    25     (f)  The student school board representatives may attend all
    26  public and nonpublic school board meetings but may be exempt
    27  from any part of meetings dealing with teacher salaries or
    28  personnel.
    29     Section 2.  The first student representatives shall be
    30  elected during the academic year beginning in 1980.
