A SUPPLEMENT 1 To the act of ( No. ), entitled "An act providing for 2 the capital budget for the fiscal year 1979-1980," itemizing 3 transportation assistance projects to be acquired or 4 constructed by the Pennsylvania Transportation Assistance 5 Authority together with their estimated financial cost; 6 authorizing the incurring of debt without the approval of the 7 electors for the purpose of financing the projects, stating 8 the estimated useful life of the projects, and making an 9 appropriation. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Itemization and Authorization of Projects.-- 13 Additional capital projects in the category of transportation 14 assistance projects with respect to which an interest is to be 15 acquired in or constructed by the Pennsylvania Transportation 16 Assistance Authority, its successors or assigns, and to be 17 financed by the incurring of debt, are hereby itemized, together 18 with the estimated financial costs and the total additional 19 amount authorized for the transportation assistance projects as 20 follows: 21 A. Allocation of Funds.--Whenever as determined by 25 the Pennsylvania Transportation Assistance Authority that the 26 full estimated financial costs of the transportation assistance 27 projects itemized in section 1 are not necessary for the proper 28 design, acquisition, or construction of such projects, the 29 excess funds no longer required may be allocated by the 30 Pennsylvania Transportation Assistance Authority to increase the 19790H1545B1822 - 3 -
1 estimated cost of any one or more of the transportation 2 assistance projects specifically itemized in a capital budget. 3 Section 3. Debt Authorization.--The Governor, Auditor 4 General and State Treasurer are hereby authorized and directed 5 to borrow, from time to time, in addition to any authorization 6 heretofore or hereafter enacted, on the credit of the 7 Commonwealth, subject to the limitations provided in the current 8 capital budget, money not exceeding in the aggregate the sum of 9 $2,700,000 as may be found necessary to carry out the 10 acquisition of the transportation assistance projects 11 specifically itemized herein. 12 Section 4. Issue of Bonds.--The indebtedness herein 13 authorized shall be incurred from time to time and shall be 14 evidenced by one or more series of general obligation bonds of 15 the Commonwealth in such aggregate principal amount for each 16 series as the Governor, Auditor General and State Treasurer 17 shall determine, but the latest stated maturity date shall not 18 exceed 30 years from the date of the bond first issued for each 19 such series. 20 Section 5. Estimated Useful Life of Projects.--The General 21 Assembly states that the estimated useful life of transportation 22 assistance projects heretofore itemized in the capital budget 23 for the fiscal year 1979-1980 is not less than 30 years from the 24 date of completion or acquisition of rights-of-way, track, 25 roadbeds, tunnels, electrification systems, structures, airport 26 improvements, buildings, stations, lands and interests therein 27 and the like; is not less than 15 years from the date of 28 acquisition of rolling stock; and is not less than 12 years from 29 the date of acquisition of passenger buses. The maximum term of 30 the debt authorized to be incurred hereunder is 30 years from 19790H1545B1822 - 4 -
1 the date of the first acquisition or completion. 2 Section 6. Appropriation.--The net proceeds of the sale of 3 the obligations herein authorized are hereby appropriated from 4 the Capital Facilities Fund to the Pennsylvania Transportation 5 Assistance Authority in the maximum amount of $2,700,000 to be 6 used by it exclusively to defray the financial costs of 7 transportation assistance projects specifically itemized in a 8 capital budget. After reserving or paying the expenses of the 9 sale of the obligation, the State Treasurer shall pay out to the 10 Pennsylvania Transportation Assistance Authority the moneys as 11 required and certified by it to be legally due and payable. 12 Section 7. Effective Date.--This act shall take effect on 13 July 1, 1979, or if enacted subsequent to that date, 14 immediately. D6L53RLC/19790H1545B1822 - 5 -
