                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, prohibiting any mandatory Department of
     3     Transportation program to require inspection of motor
     4     vehicles for emissions under terms of the Federal Clean Air
     5     Act without legislative approval.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The definition of "Federal standard" in section
     9  4102 and subsection (b) of section 4103 of Title 75, act of
    10  November 25, 1970 (P.L.707, No.230), known as the Pennsylvania
    11  Consolidated Statutes, are amended to read:
    12  § 4102.  Definitions.
    13     The following words and phrases when used in this part shall
    14  have, unless the context clearly indicates otherwise, the
    15  meanings given to them in this section.
    16     "Federal standard".  A minimum standard of vehicle or vehicle
    17  equipment performance issued under the National Traffic and
    18  Motor Vehicle Safety Act (80 Stat. 718, 15 U.S.C. § 1381), of
    19  the Motor Vehicle Information and Cost Savings Act (86 Stat.
    20  947, 15 U.S.C. § 1901) [or the Clean Air Act (81 Stat. 485, 42

     3  § 4103.  Promulgation of vehicle equipment standards.

     5     (b)  Applicability of Federal standards.--Federal standards
     6  promulgated with respect to the performance of any vehicle or
     7  item of equipment shall have the same force and effect as if
     8  promulgated by the department under subsection (a) and shall
     9  supersede any Commonwealth standard applicable to the same
    10  aspect of performance for the vehicle or item of equipment:
    11  Provided, however, That motor vehicles shall not be inspected
    12  for compliance with the provisions of the Clean Air Act (81
    13  Stat. 485, 42 U.S.C. Sec. 1857) as a condition precedent to the
    14  issuance of a certificate of inspection under this chapter.

    16     Section 2.  Section 4531 of the act is repealed.
    17     Section 3.  This act shall take effect immediately.
