AN ACT 1 Amending the act of June 2, 1915 (P.L.736, No.338), entitled, as 2 amended, "An act defining the liability of an employer to pay 3 damages for injuries received by an employe in the course of 4 employment; establishing an elective schedule of 5 compensation; providing procedure for the determination of 6 liability and compensation thereunder; and prescribing 7 penalties," providing for quarterly estimates relating to 8 certain costs of compensation. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Subsection (h) of section 306, act of June 2, 12 1915 (P.L.736, No.338), known as "The Pennsylvania Workmen's 13 Compensation Act," reenacted and amended June 21, 1939 (P.L.520, 14 No.281), added December 5, 1974 (P.L.782, No.263), is amended to 15 read: 16 Section 306. The following schedule of compensation is 17 hereby established: 18 * * * 19 (h) Any person receiving compensation under sections 306(a), 20 306(b), 306(c)(23), or section 307, as a result of an accident 21 which occurred prior to the effective date of the amendatory act
1 of [January 17, 1968 (P.L.6, No.4)] March 29, 1972 (P.L.159, 2 No.61) shall have the compensation rate adjusted to the level 3 they would have received had the injury occurred on the 4 effective date of the amendatory act of [January 17, 1968 5 (P.L.6, No.4)] March 29, 1972 (P.L.159, No.61) and had the 6 injured employe been earning wages equal to [ninety dollars 7 ($90)] one hundred and twenty dollars ($120) per week. The 8 additional compensation shall be paid by the self-insured 9 employer or insurance carrier making payment [and shall be 10 reimbursed in advance by the Commonwealth on a quarterly basis 11 as provided in rules and regulations of the department]. The 12 self-insured employer or insurance carrier making such 13 additional payments shall submit an estimate of the anticipated 14 cost for the quarter to the Commonwealth thirty (30) days in 15 advance at each quarter. The Commonwealth shall then reimburse 16 the self-insured employer or insurance carrier and any necessary 17 adjustments will be made on the estimate for the next following 18 quarter as provided in the rules and regulations of the 19 department. The payment of additional compensation shall be made 20 by the carrier or self-insured employer only during those fiscal 21 years for which appropriations are made to cover reimbursement. 22 Section 2.
