AN ACT 1 Amending the act of September 27, 1961 (P.L.1700, No.699), 2 entitled "An act relating to the regulation of the practice 3 of pharmacy, including the sales, use and distribution of 4 drugs and devices at retail; and amending, revising, 5 consolidating and repealing certain laws relating thereto," 6 providing penalties for fraud by pharmacists. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 8, act of September 27, 1961 (P.L.1700, 10 No.699), known as the "Pharmacy Act," is amended by adding a 11 clause to read: 12 Section 8. Unlawful Acts.--It shall be unlawful for: 13 * * * 14 (16) (14.1) Any pharmacist, whether licensed or not, or any <-- 15 person acting as a pharmacist, who makes PERSON TO MAKE A false <-- 16 claims CLAIM for payment. shall be guilty of a misdemeanor and <-- 17 upon conviction thereof shall be sentenced to pay a fine of one 18 thousand dollars ($1,000), IN ADDITION TO OTHER PENALTIES <-- 19 PROVIDED FOR VIOLATORS OF THIS ACT, INDIVIDUALS CONVICTED UNDER
1 THIS SECTION SHALL BE SENTENCED to make restitution of any money 2 gained through the false claim and to a suspension or revocation 3 of any license issued under this act for such time as the court 4 deems appropriate. The Attorney General shall prosecute any <-- 5 person charged with making false claims for payment from public 6 funds. 7 * * * <-- 8 Section 2. This act shall take effect in 60 days.
