                                     AN ACT

     1  Amending the act of September 27, 1961 (P.L.1700, No.699),
     2     entitled "An act relating to the regulation of the practice
     3     of pharmacy, including the sales, use and distribution of
     4     drugs and devices at retail; and amending, revising,
     5     consolidating and repealing certain laws relating thereto,"
     6     providing penalties for fraud by pharmacists.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 8, act of September 27, 1961 (P.L.1700,
    10  No.699), known as the "Pharmacy Act," is amended by adding a
    11  clause to read:
    12     Section 8.  Unlawful Acts.--It shall be unlawful for:
    13     * * *
    14     (16)  Any pharmacist, whether licensed or not, or any person
    15  acting as a pharmacist, who makes false claims for payment shall
    16  be guilty of a misdemeanor and upon conviction thereof shall be
    17  sentenced to pay a fine of one thousand dollars ($1,000), to
    18  make restitution of any money gained through the false claim and
    19  to a suspension or revocation of any license issued under this
    20  act for such time as the court deems appropriate. The Attorney

     1  General shall prosecute any person charged with making false
     2  claims for payment from public funds.
     3     Section 2.  This act shall take effect in 60 days.
