                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," imposing certain limitations on the appointment of
     5     a treasurer or secretary and requiring that all meetings be
     6     held in public buildings.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 511, act of May 1, 1933 (P.L.103, No.69),
    10  known as "The Second Class Township Code," reenacted and amended
    11  July 10, 1947 (P.L.1481, No.567) and amended March 28, 1963
    12  (P.L.9, No.6) and June 6, 1963 (P.L.71, No.47), is amended to
    13  read:
    14     Section 511.  Organization Meeting; Appointment of Secretary
    15  and Treasurer.--The supervisors of each township shall meet, at
    16  a convenient time and [place] in a public building, on the first
    17  Monday in January of each year. If the first Monday is a legal
    18  holiday, the meeting shall be held the first day following. At
    19  such time the township supervisors shall organize as a board by
    20  electing one of their number as chairman and another member as


     1  vice-chairman. The board shall appoint a treasurer and a
     2  secretary, neither of whom shall be a member of the immediate
     3  family of a supervisor, who shall be the same person, and who
     4  may or may not be a member of the board, except where the board
     5  selects a trust company or a banking institution to act as
     6  treasurer, in which case it shall elect an individual as
     7  secretary. For purposes of this section the term "immediate
     8  family of a supervisor" shall mean a spouse or child or mother
     9  or father of any supervisor.
    10     The meeting under this section may be considered as a regular
    11  monthly meeting for the transaction of such business as comes
    12  before it. The first order of business at this meeting shall be
    13  organization of the board. Any action taken or business
    14  transacted other than organization of the supervisors as a board
    15  at any organization meeting held prior to the effective date of
    16  this amending act, which is invalid for the reason that the
    17  action was taken or business transacted at an organization
    18  meeting, is hereby validated and confirmed.
    19     Section 2.  Section 512 of the act, amended November 26, 1975
    20  (P.L.453, No.125), is amended to read:
    21     Section 512.  Monthly Meetings; Quorum, Rent and Expenses.--
    22  The township supervisors shall meet for the transaction of
    23  business at least once each month, at a time and [place] in a
    24  public building to be fixed by the board, but they shall not be
    25  paid for more than sixteen meetings in any one year, except in
    26  any township where, on account of the exercise of governmental
    27  functions other than those relating to roads, more meetings are
    28  necessary, in which case, the number of meetings for which the
    29  supervisors may be paid may be increased to any number, not
    30  exceeding fifty meetings in any year which shall include

     1  hearings by aggrieved parties under the Pennsylvania Sewage
     2  Facilities Act and other hearings of a judicial or quasi-
     3  judicial nature. Two members of any board of supervisors
     4  consisting of three members shall constitute a quorum and three
     5  members of any board of supervisors consisting of five members
     6  shall constitute a quorum. Except as otherwise provided in this
     7  act, an affirmative vote of a majority of the entire board of
     8  supervisors shall be necessary in order to transact any
     9  business. Necessary expenses incurred in such meetings,
    10  including office rent, stationery, light and fuel, shall be paid
    11  out of the general township fund.
    12     Section 3.  This act shall take effect immediately and any
    13  treasurer or secretary who fails to meet the requirements of
    14  this act shall be removed from office immediately.
