AN ACT
1 Amending the act of June 5, 1968 (P.L.140, No.78), entitled "An
2 act regulating the writing, cancellation of or refusal to
3 renew policies of automobile insurance; and imposing powers
4 and duties on the Insurance Commissioner therefor," further
5 restricting increases in premiums due to moving violations.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The act of June 5, 1968 (P.L.140, No.78),
9 entitled "An act regulating the writing, cancellation of or
10 refusal to renew policies of automobile insurance; and imposing
11 powers and duties on the Insurance Commissioner therefor," is
12 amended by adding a section to read:
13 Section 4.2. No insurer shall increase an individual
14 insured's premium or assess a premium surcharge on the basis of
15 any moving traffic violation, where such violation does not
16 involve personal injury or property damage. This section shall
17 not apply to violations of 75 Pa.C.S. § 3731 (relating to
18 driving under influence of alcohol or controlled substance).
19 Section 2. This act shall take effect in 60 days.
