                                     AN ACT

     1  Amending the act of May 28, 1931 (P.L.202, No.121), entitled, as
     2     amended, "An act providing for the registration of motor
     3     boats and the regulation of vessels operated or navigated
     4     upon, over or through inland or tidal waters, whether
     5     artificial or natural, within the Commonwealth; conferring
     6     powers and imposing duties on certain police officers and the
     7     Pennsylvania Fish Commission, including the enforcement of
     8     certain existing laws; and prescribing penalties," further
     9     providing for the issuance of boat capacity plates;
    10     authorizing certain fees, making a repeal and providing for
    11     the compilation and release of statistics relating to weight
    12     carrying capacity and safe powering of vessels.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Subsection (c) of section 11, act of May 28, 1931
    16  (P.L.202, No.121), known as the "Motor Boat Law," amended
    17  October 18, 1973 (P.L.301, No.93), is amended to read:
    18     Section 11.  The Pennsylvania Fish Commission is hereby
    19  authorized and empowered to prescribe, promulgate, and enforce:

    21     (c)  Rules and regulations governing the numbering of all
    22  motor boats, special provisions applicable to livery operators,


     1  dealers and manufacturers; the display of numbers, the renewal
     2  of certificates or registration; the notices required in event
     3  of transfer of ownership, transfer of interest, abandonment or
     4  destruction of numbered vessels, and changes in owner's address;
     5  the procedures to be followed and information to be furnished by
     6  owners or operators of vessels involved in reportable boating
     7  accidents; the compilation and release of statistics on
     8  accidents and vessels numbered; weight carrying capacity and
     9  safe powering of vessels; safety equipment; and governing
    10  operation of vessels, including water skiing, the issuance of
    11  permits for races, regattas and marine parades:  Provided, That
    12  such rules and regulations are not in conflict with Federal
    13  laws, rules and regulations on the same subject matter. To this
    14  end, the commission is authorized to amend such rules and
    15  regulations as need be to maintain consonance with Federal laws
    16  and regulations.

    18     Section 2.  Section 11 of the act is amended by adding a
    19  subsection to read:
    20     Section 11.  The Pennsylvania Fish Commission is hereby
    21  authorized and empowered to prescribe, promulgate, and enforce:

    23     (i)  The Commission may issue boat capacity plates and the
    24  various permits and certificates, other than boat registrations,
    25  to implement the several programs authorized by this act in
    26  accordance with the following fee schedule:
    27     Capacity plates ....................................... $2.00
    28     Regatta permits .......................................  2.00
    29     Permits for floats,
    30     ski ramps and other

     2     Operator certificate
     3     for passenger carrying

     9     Section 3.  The act of October 25, 1967 (P.L.478, No.227),
    10  entitled "An act relating to maximum capacity of certain vessels
    11  and boats; providing for capacity plates; prescribing powers and
    12  duties of the Pennsylvania Fish Commission and prescribing
    13  penalties," is repealed.
    14     Section 4.  This act shall take effect immediately.
