        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MAY 1, 1979

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," requiring a fluorescent orange
     5     color to be worn by hunters when hunting certain animals and
     6     providing a penalty.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of June 3, 1937 (P.L.1225, No.316), known
    10  as "The Game Law," is amended by adding a section to read:
    11     Section 707.1.  Clothing or Material Worn While Hunting
    12  Certain Game; Penalty for Violation.--(a)  Whoever during the
    13  open season on deer, bear or woodchucks shall enter any
    14  woodlands  or fields within the Commonwealth for the purpose of
    15  hunting or assisting to hunt for the same shall wear or display
    16  in a conspicuous manner on his head, or chest or AND back         <--
    17  combined, a minimum of one hundred twenty square inches of        <--
    18  clothing or material of a daylight fluorescent orange color with
    19  a dominant wave length between five hundred ninety-five and six


     1  hundred five nanometers, an excitation purity of not less than
     2  eighty-five per centum and a luminance factor of not less than
     3  forty per centum: Provided, however, That when hunting for
     4  woodchuck the cloth or material of fluorescent orange color
     5  shall be worn on the head.
     6     (b)  On and after September 1, 1981, any person violating any
     7  provision of this section shall upon conviction, be sentenced to
     8  pay a fine of twenty dollars ($20.00) and costs of prosecution.
     9     (c)  The provisions of this section shall not apply to
    10  hunters participating during a season in which only muzzle
    11  loading firearms or bows and arrows may be used.
    12     Section 2.  This act shall take effect September 1, 1980.
