AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for the annual renewal of registrations 3 and drivers' licenses by the county treasurer acting as agent 4 of the department, making appropriations and repealing 5 certain provisions. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Title 75, act of November 25, 1970 (P.L.707, 9 No.230), known as the Pennsylvania Consolidated Statutes, is 10 amended by adding a section to read: 11 § 1304.1. Registration by county treasurers. 12 (a) Use of fees.--The treasurer of each county shall act as 13 the agent of the department for the receiving of applications 14 and issuing registration cards and plates for the annual 15 renewals of registration of vehicles and for the collection of 16 the fees fixed by law for such renewal of registration of 17 vehicles. From the fees established by law and collected for 18 each such renewal of registration the treasurer shall retain for 19 the use of the county the sum of $1, and all such moneys are 20 hereby appropriated for such purposes. The money so received by
1 the county shall be used for paying salaries of clerical help, 2 postage, stationery and all other expenses incurred in issuing 3 such registrations and the balance thereof for the construction, 4 maintenance and repair of roads and bridges. 5 (b) Records to be kept.--The treasurer of each county shall 6 keep in his office a file or book to be furnished by the 7 department containing at all times a correct and complete record 8 of all renewal registrations issued by him and he shall at the 9 end of each week transmit to the department all such 10 applications received by him, a statement showing all 11 registrations issued by him, and the numbers assigned to each 12 applicant, all fees collected by him during such weeks, and any 13 other information and data the department may require. 14 (c) Records open to inspection.--All books, records and 15 papers of the county treasurer relating to the registration of 16 vehicles shall, at any reasonable time, be open to the 17 inspection of any officer of the Commonwealth and to any 18 representative of the department or the Department of the 19 Auditor General. 20 (d) Renewals.--Any owner of a vehicle who desires to renew 21 the registration of such vehicle as provided by law may make 22 application for such renewal of registration to the treasurer of 23 his respective county or, if the applicant is not a resident of 24 any county of the Commonwealth, then the application may be made 25 to the treasurer of the county in which such applicant may be 26 for the time being. Such application shall be made on blanks to 27 be furnished by the department and shall be in the same form as 28 now or hereafter prescribed by law. 29 (e) Payment of fee, issuance of plates and cards.--At the 30 time of making such application for renewal of registration, 19790H0522B0562 - 2 -
1 there shall be paid to the county treasurer the registration fee 2 now or hereafter fixed by law, whereupon the proper registration 3 plates and cards which shall be furnished by the department 4 shall be issued to the applicant by the treasurer. 5 Section 2. Sections 1305(a) and 1308(a) of Title 75 are 6 amended to read: 7 § 1305. Application for registration. 8 (a) General rule.--Application for the registration of a 9 vehicle shall be made either to the treasurer of the county in 10 which the applicant resides or as hereinbefore provided for 11 applicants not having a residence within the Commonwealth or to 12 the department upon the appropriate form or forms furnished by 13 the department. The application shall contain the full name and 14 address of the owner or owners; the make, model, year and 15 vehicle identification number of the vehicle; and such other 16 information as the department may require. Applicants for 17 registration of a truck, truck tractor, trailer or bus shall 18 provide the vehicle's Gross Vehicle Weight Rating (GVWR), or the 19 Gross Combination Weight Rating (GCWR), as applicable. If the 20 manufacturer's ratings are not available, the applicant shall 21 provide sufficient information as to the horsepower, braking 22 capacity and such other data as necessary for the department to 23 determine an equivalent measure of the vehicle's hauling and 24 stopping capability. If the applicant wishes to register a 25 vehicle at a registered gross weight less than the gross vehicle 26 weight rating, the application shall include information as to 27 weight, load and any other such information as the department 28 may require. 1 § 1308. Issuance of registration card. 2 (a) General rule.--The department, upon registering a 3 vehicle, or renewing a registration thereof or the county 4 treasurer acting as the agent of the department upon receiving a 5 proper application for the renewal of registration of a vehicle 6 from a person entitled thereto as herein provided, together with 7 the fee fixed by this act, shall issue to the registrant a 8 registration card which shall contain the registration number 9 assigned to the vehicle, the name and address of the registrant 10 and the name of the owner, if other than the registrant, a 11 description of the vehicle including the vehicle identification 12 number, the expiration date and such other information as may be 13 determined by the department. 14 * * * 15 Section 3. Section 1309 of Title 75 is repealed. 16 Section 4. Section 1510(a) of Title 75 is amended to read: 17 § 1510. Issuance and content of driver's license. 18 (a) General rule.--The department shall, either directly or 19 through the county treasurer as hereinafter provided upon 20 payment of the required fee, issue to every qualified applicant 21 a driver's license indicating the type or general class of 22 vehicles the licensee is authorized to drive, which license 23 shall contain a distinguishing number identifying the licensee, 24 the actual name, date of birth, residence address, a color 25 photograph of the licensee, such other information as may be 26 required by the department, and either a facsimile of the 27 signature of the licensee or a space upon which the licensee 28 shall write his usual signature with pen and ink. Personal 29 medical data and other information for use in an emergency may 30 be included as a part of the license. Information other than 19790H0522B0562 - 4 -
1 that required to identify the licensee, the distinguishing 2 number and the class of license issued may be included in 3 microdata form. No driver's license shall be valid until it has 4 been signed by the licensee. 5 * * * 6 Section 5. Title 75 is amended by adding a section to read: 7 § 1510.1. Issuance of drivers' licenses by counties. 8 (a) Use of fees.--The treasurer of each county shall act as 9 the agent of the department for the receiving of applications 10 and issuing driver's license cards for the renewals of drivers' 11 licenses and for the collection of the fees fixed by law for 12 such renewals. From the fees established by law and collected 13 for each such renewal the treasurer shall retain for the use of 14 the county the sum of 50¢, and all such moneys are hereby 15 appropriated for such purposes. 1 drivers' licenses shall, at any reasonable time, be open to the 2 inspection of any officer of the Commonwealth and to any 3 representative of the department or the Department of the 4 Auditor General. 5 (d) Renewal.--Any licensed driver who desires to renew his 6 driver's license as provided by law may make application for 7 such renewal to the treasurer of his respective county or, if 8 the applicant is not a resident of any county of the 9 Commonwealth, then the application may be made to the treasurer 10 of the county in which such applicant may be for the time being. 11 Such applications shall be made on blanks to be furnished by the 12 department and shall be in the same form as now or hereafter 13 prescribed by law. 14 (e) Payment of fees; issuance of cards.--At the time of 15 making such application for renewal of drivers' licenses, there 16 shall be paid to the county treasurer the fee now or hereafter 17 fixed by law, whereupon the proper cards which shall be 18 furnished by the department shall be issued to the applicants by 19 the treasurer. 20 Section 6.
