                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," providing
     4     for expense moneys in lieu of salary.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1001, act of February 1, 1966 (1965
     8  P.L.1656, No.581), known as "The Borough Code," amended October
     9  12, 1973 (P.L.289, No.85), is amended to read:
    10     Section 1001.  Organization of Council; Quorum; Compensation;
    11  Eligibility.--The borough council shall organize on the first
    12  Monday of January of each even-numbered year, by electing one of
    13  their number as president and one of their number as vice-
    14  president, who shall hold such offices at the pleasure of the
    15  council. If the first Monday is a legal holiday, the meeting and
    16  organization shall take place the first day following. Any
    17  action taken by any borough council at any time between 12:01
    18  o'clock ante meridian on January 1 of an even-numbered year and
    19  the organization of council in that year shall be subject to


     1  reconsideration by the new council at any time within ten days
     2  after such organization. The council may at the organization
     3  meeting elect such other officers as may be provided for by law
     4  or ordinance, or as may be deemed necessary for the conduct of
     5  affairs of the borough and may transact such other business as
     6  may come before the meeting. The president, and during his
     7  absence or incapacity the vice-president, shall preside over the
     8  meetings of council and perform such other duties as are
     9  prescribed by this act or by ordinance. A majority of the
    10  membership of council then in office shall constitute a quorum.
    11  Councilmen may receive [compensation] expense moneys to be fixed
    12  by ordinance at any time and from time to time as follows: In
    13  boroughs whose population is less than fifteen hundred, a
    14  maximum of thirty-five dollars ($35) a month; in boroughs whose
    15  population is fifteen hundred or more but less than three
    16  thousand, a maximum of fifty dollars ($50) a month; in boroughs
    17  whose population is three thousand or more but less than five
    18  thousand, a maximum of seventy-five dollars ($75) a month; in
    19  boroughs whose population is five thousand or more but less than
    20  ten thousand, a maximum of one hundred twenty-five dollars
    21  ($125) a month; in boroughs whose population is ten thousand or
    22  more but less than fifteen thousand, a maximum of two hundred
    23  dollars ($200) a month; and in boroughs whose population is
    24  fifteen thousand or more, a maximum of two hundred fifty dollars
    25  ($250) a month.
    26     The population shall be determined by the latest available
    27  official census figures. In no case shall the [compensation]
    28  expense moneys for any councilman exceed [that] the compensation
    29  of the mayor in any given borough: Provided, however, That
    30  wherever the mayor's compensation exceeds [that] expense moneys

     1  authorized by this section for councilmen, the president of
     2  council may receive [compensation] expense moneys not to exceed
     3  [that] compensation of the office of mayor.
     4     Section 2.  This act shall take effect immediately.
