           REPRESENTATIVES, AS AMENDED, JUNE 25, 1980

                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing tuition credit at
     3     certain colleges and schools INSTITUTIONS OF HIGHER LEARNING   <--
     4     for members of the National Guard.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 51, act of November 25, 1970 (P.L.707,
     8  No.230), known as the Pennsylvania Consolidated Statutes, is
     9  amended by adding a section to read:
    10  § 3104.  Tuition credit.                                          <--
    11     (a)  Credit.--A member of the Pennsylvania National Guard
    12  with a minimum of one year of satisfactory service, who is a
    13  resident of Pennsylvania and who enrolls in a State college or
    14  university, or State aided college or university, or technical
    15  school shall receive a credit of 50% of the tuition charges of
    16  the university, college or school. The credit shall be
    17  continuous so long as the member maintains satisfactory
    18  performance with the Pennsylvania National Guard and meets the

     1  normal requirements of the institution.
     2     (b)  Certification.--Upon request of a member of the National
     3  Guard entitled to credit under subsection (a), the commanding
     4  officer shall attest to the performance of the member in the
     5  National Guard and send the same to the appropriate institution.
     6  Certification of satisfactory performance shall be accomplished
     7  at the time of enrollment for each semester or academic term for
     8  which tuition credit is requested.
     9  § 3104.  TUITION CREDIT.                                          <--
    10     (A)  ELIGIBILITY.--A NONTECHNICIAN MEMBER OF THE PENNSYLVANIA
    11  NATIONAL GUARD IN AN ENLISTED GRADE, WARRANT OFFICER, WO1 OR
    12  WO2, OR OFFICERS IN THE RANK OF SECOND LIEUTENANT OR FIRST
    13  LIEUTENANT AFTER COMPLETING A MINIMUM ENLISTMENT PERIOD AS
    14  DEFINED BY THE GUARD, WHO ENROLLS IN A PENNSYLVANIA INSTITUTION
    15  OF HIGHER LEARNING, WITH DEGREE GRANTING STATUS AS APPROVED BY
    16  THE DEPARTMENT OF EDUCATION AND THE PENNSYLVANIA HIGHER
    17  EDUCATION ASSISTANCE AGENCY, SHALL RECEIVE A GRANT OF $40 PER
    18  CREDIT WHILE SATISFACTORILY ENROLLED, WITH A MAXIMUM OF SIX
    19  CREDITS PER QUARTER OR SEMESTER OR 12 CREDITS PER YEAR.
    20     (B)  PAYMENT.--GRANTS SHALL BE PAID ONLY UPON CERTIFICATION
    21  EACH QUARTER OR SEMESTER BY THE ADJUTANT GENERAL THAT THE
    22  STUDENT IS A CURRENT MEMBER IN GOOD STANDING WITH THE
    23  PENNSYLVANIA NATIONAL GUARD AND THAT HIS CURRENT ENLISTMENT
    24  EXTENDS BEYOND THE EXPIRATION DATE OF THE CURRENT QUARTER OR
    25  SEMESTER.
    26     (C)  ADMINISTRATION.--THE PENNSYLVANIA HIGHER EDUCATION
    27  ASSISTANCE AGENCY SHALL ADMINISTER THE EDUCATIONAL GRANTS
    28  PROVIDED IN THIS SECTION FROM AN APPROPRIATION MADE ANNUALLY TO
    29  THE AGENCY FOR THIS PURPOSE.
    30     Section 2.  This act shall take effect in 60 days.
