AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 confirmation of gubernatorial appointees. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Clause (6) of subsection (d) of section 207.1, 25 act of April 9, 1929 (P.L.177, No.175), known as "The 26 Administrative Code of 1929," added November 8, 1976 (P.L.1109, 27 No.227), is amended to read:
1 Section 207.1. Gubernatorial Appointments.--* * * 2 (d) The Governor shall nominate in accordance with the 3 provisions of the Constitution of the Commonwealth of 4 Pennsylvania and, by and with the advice and consent of a 5 majority of the members elected to the Senate appoint persons to 6 fill the following positions: 7 * * * 8 (6) All other positions [hereinafter] statutorily created 9 [by amendment to this act or in any other act or amendment 10 thereto] for which Senate confirmation is specified but for 11 which the advice and consent of two-thirds of the members 12 elected to the Senate is not required and appointments made by 13 the Governor to fill vacancies in elective offices not 14 enumerated herein. 15 * * * 16 Section 2. Section 6, act of November 8, 1976 (P.L.1109, 17 No.227), entitled "An act amending the act of April 9, 1929 18 (P.L.177, No.175), entitled 'An act providing for and 19 reorganizing the conduct of the executive and administrative 20 work of the Commonwealth by the Executive Department thereof and 21 the administrative departments, boards, commissions, and 22 officers thereof, including the boards of trustees of State 23 Normal Schools, or Teachers Colleges; abolishing, creating, 24 reorganizing or authorizing the reorganization of certain 25 administrative departments, boards, and commissions; defining 26 the powers and duties of the Governor and other executive and 27 administrative officers, and of the several administrative 28 departments, boards, commissions, and officers; fixing the 29 salaries of the Governor, Lieutenant Governor, and certain other 30 executive and administrative officers; providing for the 19790H0324B0344 - 2 -
1 appointment of certain administrative officers, and of all 2 deputies and other assistants and employes in certain 3 departments, boards, and commissions; and prescribing the manner 4 in which the number and compensation of the deputies and all 5 other assistants and employes of certain departments, boards and 6 commissions shall be determined,' changing the confirmation 7 requirements for certain gubernatorial appointments," is 8 repealed. 9 Section 3.
