                                     AN ACT

     1  Amending the act of July 31, 1968 (P.L.788, No.241), entitled
     2     "An act providing for the planning and regulation of solid
     3     waste storage, collection, transportation, processing and
     4     disposal systems; requiring municipalities to submit plans
     5     for solid waste management systems in their jurisdiction;
     6     authorizing grants to municipalities; requiring permits for
     7     operating processing or disposal systems; imposing duties on
     8     and granting powers to municipalities; authorizing the
     9     Department of Health to adopt rules, regulations, standards
    10     and procedures; creating an advisory committee; providing
    11     remedies, prescribing penalties, and making an
    12     appropriation," further providing for certain publication and
    13     notice.

    14     The General Assembly of the Commonwealth of Pennsylvania
    15  hereby enacts as follows:
    16     Section 1.  Subsections (b) and (c) of section 7, act of July
    17  31, 1968 (P.L.788, No.241), known as the "Pennsylvania Solid
    18  Waste Management Act," are amended to read:
    19     Section 7.  Applications and Permits.-- * * *
    20     (b)  Application for a permit shall be in writing and shall
    21  be made on a form prescribed, prepared and furnished by the
    22  department and shall set forth such information and be


     1  accompanied by such data as the department may require. Upon
     2  receipt of such application, the department shall publish notice
     3  of the application in the Pennsylvania Bulletin and shall notify
     4  the municipality in which the facility or area is to be located
     5  by certified mail.
     6     (c)  Upon approval of the application, the department shall
     7  issue a permit for the operation of each solid waste processing
     8  or disposal facility or area set forth in the application and
     9  shall publish notice of such approval in the Pennsylvania
    10  Bulletin and shall notify the municipality by certified mail.

    12     Section 2.  This act shall take effect in 60 days.
