                                     AN ACT

     1  Establishing visitation rights for married inmates of State
     2     correctional institutions.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Family visitation privilege.
     6     In addition to any other visitation privileges presently
     7  extended to inmates of State correctional institutions, any
     8  married inmate of a State correctional institution shall be
     9  permitted once each month to visit within the institution with
    10  his or her spouse in complete privacy for a period determined by
    11  the Department of Justice which shall be not less than five
    12  hours.
    13  Section 2.  Suspension of privilege.
    14     The visitation privileges provided by section 1 may be
    15  terminated or suspended by the superintendent of the institution
    16  with respect to any inmate if, during the visitation period,
    17  such inmate or his or her visiting spouse violates any law or


     1  rule or regulation promulgated by the Bureau of Correction
     2  dealing with prisoner visitation, or violates the provisions of
     3  18 Pa.C.S. § 5121 (relating to escape), § 5122 (relating to
     4  weapons or implements for escape), or § 5123 (relating to
     5  contraband).
     6  Section 3.  Effective date.
     7     This act shall take effect in 60 days.
