AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," providing for the election 21 of the State Civil Service Commission. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Section 452, act of April 9, 1929 (P.L.177, 25 No.175), known as "The Administrative Code of 1929," amended 26 June 25, 1947 (P.L.950, No.386), is amended to read: 27 Section 452. State Civil Service Commission.--The State 28 Civil Service Commission is hereby created, and shall consist of
1 [three] five elected members[, not more than two of whom shall 2 be of the same political affiliation. Of the original members, 3 all of whom shall be appointed within thirty days after the 4 effective date of this act, one shall be appointed for a term of 5 two years, one for a term of four years, and one for a term of 6 six years, from the date of his appointment and until his 7 successor shall have been appointed and qualified. Thereafter, 8 each appointment shall be for a term of six years or until a 9 successor is appointed and qualified]. Three of the members 10 shall be elected for four year terms and two of the members 11 shall be elected for two year terms. Terms shall begin January 1 12 following their election. In the event of a vacancy the Governor 13 shall appoint a person to fill the unexpired term. The 14 Commonwealth shall be divided by the Reapportionment Commission 15 into five civil service districts of equal population and one 16 commissioner shall be elected from each district. Nomination and 17 election of a candidate for the office of Commissioner of the 18 State Civil Service Commission shall be governed by the act of 19 June 3, 1937 (P.L.1333, No.320), known as the "Pennsylvania 20 Election Code." Nominating petitions shall contain 2,500 21 signatures of the electorate registered with the candidate's 22 party and residing in the candidate's district. If the district 23 contains two or more counties not more than 50% of the 24 signatures shall be from one county. The members of the 25 commission shall hold no other public position to which a salary 26 is attached[, shall have qualifications for appointment,] and 27 shall be removable from office, as provided by the law. The 28 [Governor shall designate] commissioners shall elect one of the 29 members as chairman who shall serve for a one-year term 30 commencing January 3 and shall not be eligible for reelection. 19790H0086B0097 - 2 -
1 [Each member of the commission shall receive actual traveling 2 expenses and per diem compensation at the rate of twenty-five 3 dollars per day for the time actually devoted to the business of 4 the commission, but no member shall be paid more than three 5 thousand dollars per diem compensation in any one year.] 6 No person shall be elected commissioner if he was employed by 7 an agency of the Commonwealth during the three years prior to 8 his election nor may he be so employed during the three-year 9 period after terminating his position as a commissioner. No 10 commissioner shall seek a Statewide elected position, nor a seat 11 in the United States or Pennsylvania House of Representatives or 12 the United States or Pennsylvania Senate during the three-year 13 period after terminating his position as a commissioner. 14 Each member of the commission shall be compensated at $14,000 15 per year, except the chairman who shall be compensated at 16 $15,000 per year. 17 Section 2. The terms of the present members of the State 18 Civil Service Commission shall expire January 1, 1981 when the 19 newly elected commissioners shall take office. 20 Section 3. The act of August 5, 1941 (P.L.752, No.286), 21 known as the "Civil Service Act" is repealed insofar as 22 inconsistent with the provisions of this act. 23 Section 4.
