AN ACT 1 Providing for the termination of all agencies, boards, 2 commissions, committees, departments and similar units of 3 State Government that have not been created by statutes 4 enacted by the General Assembly; establishing a committee to 5 oversee the termination and providing a limited time period 6 for the continuation of certain agencies, boards, 7 commissions, committees, departments and similar units of 8 State Government. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. This act shall be known and may be cited as the 12 "Non-statutory Agency Termination Act." 13 Section 2. There is hereby established a joint General 14 Assembly Committee to be known as the "Leadership Committee." 15 The committee shall be composed of the Speaker of the House of 16 Representatives the President pro tempore of the Senate and the 17 Majority and Minority Leaders of the House of Representatives 18 and the Senate. 19 The Speaker of the House of Representative shall serve as the
1 temporary chairman of the committee until such time as the 2 committee shall meet and elect its own chairman. 3 Section 3. All agencies, boards, commissions, committees, 4 departments or similar units of State Government not created by 5 statute enacted by the General Assembly shall be terminated on 6 November 30, 1980, or one calendar year from the date of their 7 creation, whichever is later. 8 Section 4. Whenever the Governor determines that an agency, 9 board, commission, committee, department or other similar unit 10 of State Government should continue to exist, the Governor shall 11 notify the General Assembly of this desire prior to the proposed 12 date for termination. 13 Section 5. The Leadership Committee may grant the terminated 14 agency an extension of not more than six months while the 15 General Assembly considers the necessity of recreating the 16 terminated agency. The Leadership Committee shall refer the 17 question of possible recreation of an agency to the appropriate 18 committee or committees in both the Senate and the House of 19 Representatives. 20 Section 6. The Governor shall not reinstitute any agency, 21 board, commission, committee, department or other similar unit 22 of State Government terminated pursuant to this law, nor shall 23 the Governor establish or constitute a similar agency to carry 24 out the terminated functions. 25 Section 7. Employees of terminated agencies, boards, 26 commissions, committees, departments and similar units of State 27 Government who have civil service status or who are covered by 28 union contracts shall fill any existing vacancies within the 29 administrative branch of State Government in their grade and 30 position. 1 the time of termination, then such terminated employees shall 2 receive employment in the first vacancies that shall thereafter 3 exist in their grade and rank. 4 Section 8. All acts or parts of acts inconsistent with the 5 provisions of this act are repealed to the extent of the 6 inconsistency. 7 Section 9. This act shall take effect immediately.
