                           In the House of Representatives, June 7, 1977

     1     WHEREAS, The practice of brown bagging liquor into unlicensed
     2  premises has been creating public nuisances as well as depriving
     3  the Commonwealth of much needed revenue; and
     4     WHEREAS, The Commonwealth Court recently stated that the
     5  purpose of the Liquor Code is to regulate and restrain the sales
     6  of liquor, not to promote them; and
     7     WHEREAS, The Liquor Code expressly authorizes only licensed
     8  establishments and the privacy of ones home as being legally
     9  acceptable for places that alcoholic beverages can be possessed,
    10  furnished or stored and that licensed establishments only may
    11  sell alcoholic beverages for consumption on the licensed
    12  premises; therefore be it
    13     RESOLVED, That the House of Representatives direct the Liquor
    14  Control Board members to uphold their oath of office and enforce
    15  the laws and the penalties provided in a consistent manner as
    16  they apply to the illegal practice of patrons furnishing and
    17  consuming alcoholic beverages in unlicensed establishments.
