In the House of Representatives, June 7, 1977 1 On July 25, 1973, the House of Representatives adopted House 2 Resolution No.98, Printer's No.1381, which created a select 3 committee to investigate State agencies, individuals, 4 corporations, consultants, advisors, and entities involved in 5 purchasing, leasing, construction and disposal of Commonwealth 6 property, services and supplies. 7 Under the provisions of the resolution, the select committee 8 was given the power to issue subpoenas. Among the records which 9 were subpoenaed were those belonging to political committees 10 from thirty-two counties which are geographically located within 11 the Federal Middle District of Pennsylvania. 12 While the above mentioned subpoenaed records were still in 13 the possession of the select committee, a Federal grand jury 14 subpoenaed them from the select committee. These records have 15 never been returned to the political committees from which they 16 were originally subpoenaed and are presently being held in the 17 office of the United States Attorney for the Middle District of
1 Pennsylvania. 2 The select committee went out of existence upon the 3 termination of the 1974 session of the Legislature. A 4 communication has been received from the office of the United 5 States Attorney for the Middle District of Pennsylvania 6 requesting direction from the House of Representatives as to 7 what manner the House wishes his office to return the subpoenaed 8 records; therefore be it 9 RESOLVED, That the Speaker of the House of Representatives 10 appoint a three-member bipartisan committee, two from the 11 majority party and one from the minority party for the purpose 12 of receiving the above mentioned subpoenaed records from the 13 office of the United States Attorney and returning such records 14 to the individual political committees from which they were 15 originally subpoenaed by the select committee; and be it further 16 RESOLVED, That the committee communicate with the United 17 States Attorney for each of the Federal districts of 18 Pennsylvania and determine whether any of their offices are in 19 possession of any records subpoenaed from the above mentioned 20 select committee or any other committee of the House no longer 21 in existence. The committee is hereby authorized to accept any 22 such additional subpoenaed records for the purpose of returning 23 them to those from whom such records were originally subpoenaed; 24 and be it further 25 RESOLVED, That the Chief Clerk of the House of 26 Representatives is hereby directed to provide to the committee 27 any staff necessary to fulfill the purpose of the committee and 28 any space required for the temporary storage of such records; 29 and be it further 30 RESOLVED, That no member of the committee, nor any other 19770H0110R1509 - 2 -
1 person, shall have access to any such records except for the 2 purpose of transferring such records from the office of the 3 United States Attorney to the person or entity from whom such 4 records were originally subpoenaed; and be it further 5 RESOLVED, That the committee shall report to the House upon 6 completion of its assignment.
