                                     AN ACT

     1  Providing for reimbursement to the counties for the cost of
     2     operating the courts and related offices.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  For the fiscal year July 1, 1978 to June 30,
     6  1979, the Commonwealth shall reimburse the counties for the cost
     7  of administration and operations of the courts as provided in
     8  the act of June 22, 1978 (No.48A), known as the "Federal Revenue
     9  Sharing Trust Fund Supplement to the General Appropriation Act
    10  of 1978."
    11     Section 2.  (a)  After June 30, 1979, the Commonwealth shall
    12  reimburse the counties for the cost of operating the courts and
    13  related offices.
    14     (b)  On or before July 30, October 30, January 30 and April
    15  30 of each year, the county commissioner or the chief
    16  administrative officer of a Home Rule Charter County shall
    17  prepare and have certified by the county treasurer or county
    18  controller a report listing actual expenditures made on behalf

     1  of the offices of the courts for the preceding three months. The
     2  reports shall include but not be limited to expenditures for
     3  salaries, supplies, fringe benefits, overhead costs including
     4  but not limited to maintenance, utilities and equipment,
     5  ancillary services and rental costs, as well as other certified
     6  expenditures of the various divisions of the courts of common
     7  pleas, office of the jury commission, juvenile and adult
     8  probation and placement services, offices appointed by the court
     9  to provide research and expertise such as administrative
    10  offices, boards of view, behavior or psychological clinics, for
    11  law libraries, for the provision of offices and staff to
    12  appellate court judges who reside in the county and for the net
    13  cost, if any, to the county for the operation of the minor
    14  judiciary.
    15     (c)  The reports shall be submitted to the Department of
    16  Community Affairs.
    17     Section 3.  (a)  The Department of Community Affairs shall:
    18         (1)  Prepare report forms and distribute them to the
    19     counties.
    20         (2)  Compute the reimbursement due each county based on
    21     the report and the following percentages:
    22             (i)  Costs for operation of the appellate court
    23         judges shall be reimbursed in full beginning July 1,
    24         1979.
    25             (ii)  Except for costs reimbursed under subparagraph
    26         (i), reimbursement for costs shall be at the rate of 60%
    27         for the fiscal year 1979-1980; 80% for the fiscal year
    28         1980-1981; 90% for the fiscal year 1981-1982; and, 100%
    29         thereafter.
    30         (3)  Transmit a voucher to the State Treasurer in the

     1     amounts due each county no later than one month following the
     2     receipt of the report from a county.
     3     (b)  The State Treasurer shall promptly make payments to the
     4  counties.
     5     Section 4.  This act shall take effect immediately.
