AN ACT
1 Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
2 "An act relating to roads, streets, highways and bridges;
3 amending, revising, consolidating and changing the laws
4 administered by the Secretary of Highways and by the
5 Department of Highways relating thereto," requiring that all
6 equipment leases be awarded to qualified lessors on the basis
7 of competitive bids.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. The act of June 1, 1945 (P.L.1242, No.428), known
11 as the "State Highway Law," is amended by adding a section to
12 read:
13 Section 403.1. Equipment Leases.--(a) The department shall
14 not enter into any lease for any equipment to be utilized for
15 the construction, building or rebuilding, repairing and
16 maintenance, or snow clearance or removal of any highway covered
17 by the provisions of this act unless and until the lessor is
18 selected as the lowest responsible lessor on the basis of
19 competitive bids pursuant to section 404.
1 (b) All payments for any leases shall be made directly to
2 the lessor from the comptroller of the department.
3 Section 2. This act shall take effect in 60 days.
