                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further providing for the collection of garbage in
     5     villages.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Clause VIII of section 702, act of May 1, 1933
     9  (P.L.103, No.69), known as "The Second Class Township Code,"
    10  reenacted and amended July 10, 1947 (P.L.1481, No.567), is
    11  amended by adding a subclause to read:
    12     Section 702.  Supervisors to Exercise Powers.--The corporate
    13  powers of townships of the second class shall be exercised by
    14  the township supervisors. Where no specific authority is given
    15  for the expenditures incident to the exercise of any power
    16  hereinafter conferred, or where no specific fund is designated
    17  from which such expenditures shall be made, appropriations for
    18  such expenditures shall be made only from the general township
    19  fund. In addition to the duties imposed upon them by section 516
    20  hereof, they shall have power--

     2     VIII.  Ashes, Garbage, Rubbish and Other Refuse Materials.--
     3  To regulate or prohibit the dumping or otherwise depositing of
     4  ashes, garbage, rubbish and other refuse materials within the
     5  township. To prohibit accumulations of ashes, garbage, rubbish
     6  and other refuse materials upon private property, including the
     7  imposition and collection of reasonable fees and charges for the
     8  collection, removal and disposal thereof. They shall also have
     9  power to--

    11     (3)  When there is, in any village as designated in subclause
    12  (2), an existing garbage collection and disposal system that is
    13  based upon a per capita assessment, on petition of a majority of
    14  the adult taxable residents of the village, the supervisors
    15  shall eliminate the per capita assessment and substitute an
    16  assessment based upon all occupied units in the village. The
    17  assessment shall be collected and reported in the same manner as
    18  assessments are collected and reported in subclause (2).
