AN ACT 1 Amending the act of May 27, 1937 (P.L.926, No.249), entitled, as 2 amended, "An act relating to the manufacture, repair, 3 renovating, cleansing, sterilizing, and disinfecting of 4 mattresses, pillows, bolsters, feather beds, and other filled 5 bedding, cushions, upholstered furniture and bulk materials 6 intended for use in such products intended for sale or lease, 7 and to the sale or lease thereof; requiring the placing of 8 tag and adhesive stamp on such material; providing for the 9 sale of adhesive stamps; authorizing and requiring the 10 Department of Labor and Industry to adopt rules and 11 regulations; providing penalties; and repealing certain 12 acts," providing for filled clothing. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Sections 1, 7(e) and 12(c), act of May 27, 1937 16 (P.L.926, No.249), referred to as the Bedding and Upholstery 17 Law, are amended to read: 18 Section 1. Be it enacted, &c., That the provisions herein 19 set forth shall be construed to cover and apply to the 20 manufacture, repair, and renovation of all mattresses, pillows, 21 bolsters, feather beds, and other filled bedding and filled 22 clothing of any description, also to cushions and all types of
1 upholstered furniture which are intended for sale or lease in 2 this Commonwealth, and to the sale or lease thereof. 3 Section 7. * * * 4 (e) The size of the tag required by this section shall be 5 not less than six (6) square inches, and the lettering thereon, 6 covering the statement of filling materials and whether new or 7 secondhand, shall be in plain type not less than one-eighth 8 (1/8) inch in height: Provided, however, That the department may 9 by rules and regulations specify a tag of a smaller size to be 10 placed on all filled clothing covered by this amending act. 11 Section 12. * * * 12 (c) Each mattress, pillow, bolster, feather bed, [and] or 13 other filled bedding, or filled clothing, cushion, or article of 14 upholstered furniture manufactured, repaired, or renovated, 15 sold, offered for sale, or leased or possessed with intent to 16 sell or lease, contrary to the provisions of this act or of the 17 rules and regulations established thereunder, shall constitute a 18 separate offense and shall be punishable as provided in [clause] 19 subsection (a) of this section. 20 Section 2. This act shall take effect in 60 days as to all 21 items of filled clothing manufactured after the passage of this 22 amending act and shall be effective in one year as to all items 23 of filled clothing manufactured on or before the passage of this 24 amending act in accordance with rules and regulations to be 25 promulgated by the department.
