                                     AN ACT

     1  Requiring the use of safety tire racks in certain instances.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Definition.
     5     The term "entity" shall mean any sole proprietorship,
     6  partnership, joint venture, corporation, association or
     7  political subdivision, in the Commonwealth of Pennsylvania.
     8  Section 2.  Safety requirements; split rim tires.
     9     Any entity whose employees inflate, mount or dismount tires
    10  shall provide a safety tire rack, cage or equivalent protection
    11  which shall be used when inflating, mounting or dismounting
    12  tires installed on split rims, or rims equipped with locking
    13  rings or similar devices.
    14  Section 3.  Rules and regulations; enforcement.
    15     The Department of Labor and Industry shall promulgate rules
    16  and regulations to carry out the purposes of this act and shall
    17  be responsible for the enforcement of the provisions of this

     1  act.
     2  Section 4.  Penalties.
     3     Any person who violates the provisions of this act or the
     4  rules and regulations adopted pursuant thereto is guilty of a
     5  misdemeanor of the third degree as defined in section 106 of
     6  Title 18 of the Pennsylvania Consolidated Statutes (relating to
     7  classes of offenses).
     8  Section 5.  Effective date.
     9     This act shall take effect in 60 days.
