AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," granting additional 21 supervisory powers to the Department of Agriculture over 22 certain State lands presently supervised by the Department of 23 Public Welfare and authorizing certain leasing arrangements 24 by the Department of Agriculture. 25 The General Assembly of the Commonwealth of Pennsylvania 26 hereby enacts as follows: 27 Section 1. The act of April 9, 1929 (P.L.177, No.175), known
1 as "The Administrative Code of 1929," is amended by adding a 2 section to read: 3 Section 1712. Supervision over Certain Lands.--(a) The 4 supervisory power over State lands adjoining or surrounding 5 State institutions exercised by the Department of Public 6 Welfare, which lands have been or are presently used for 7 agricultural purposes, is hereby transferred to the Department 8 of Agriculture. 9 (b) The Department of Agriculture shall undertake a complete 10 examination of these State lands to determine the best 11 agricultural use of the land. Within ninety (90) days of the 12 effective date of this act, the Department of Agriculture shall 13 establish a lease program where the lands so supervised shall be 14 returned to full agricultural production by the highest 15 successful bidder. 16 (c) The Department of Agriculture shall adopt such rules and 17 regulations as are necessary to implement and administer the 18 provisions of subsection (b). 19 Section 2. (a) The act of April 9, 1929 (P.L.177, No.175), 20 known as "The Administrative Code of 1929," is repealed insofar 21 as it grants supervisory powers over State lands surrounding or 22 adjoining State institutions subject to the jurisdiction of the 23 Department of Public Welfare. 24 (b) The act of June 13, 1967 (P.L.31, No.21), known as the 25 "Public Welfare Code," is repealed insofar as it grants 26 supervising powers over State lands surrounding or adjoining 27 State institutions subject to the jurisdiction of the Department 28 of Public Welfare. 29 Section 3.
