        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MARCH 15, 1977

                                     AN ACT

     1  Amending the act of March 19, 1951 (P.L.28, No.4), entitled "An
     2     act relating to the civil defense of this State and its
     3     coordination with national defense; providing for the
     4     establishment of a State Council of Civil Defense, local and
     5     district councils of civil defense, Mobile Support Units;
     6     prescribing the powers, duties and immunities thereof and of
     7     their personnel; authorizing mutual aid compacts, and
     8     providing penalties," permitting State agencies to purchase
     9     materials and supplies during emergencies without bids.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  The act of March 19, 1951 (P.L.28, No.4), known
    13  as the "State Council of Civil Defense Act of 1951," is amended
    14  by adding a section to read:
    15     Section 7.1.  Emergency Purchases by Commonwealth Agencies.--  <--
    16  (A)  A State agency may, for a period of thirty (30) days         <--
    17  following the date of OR IMMEDIATELY AFTER an emergency IS        <--
    18  declared by the Governor, incur obligations for or purchase such
    19  materials and supplies as may be necessary to combat a disaster,
    20  protect the health and safety of persons and property and
    21  provide emergency assistance to victims of a disaster without

     1  complying with formal bidding or other time consuming contract
     2  procedures.
     3     (B)  THE COST OF MATERIALS AND SUPPLIES PURCHASED PURSUANT TO  <--
     4  SUBSECTION (A) SHALL NOT EXCEED TEN PERCENT OF THE PRICE OF THE
     5  SAME THE DAY BEFORE THE EMERGENCY.
     6     (C)  MATERIALS AND SUPPLIES PURCHASED PURSUANT TO SUBSECTION
     7  (A) SHALL ONLY BE USED IN THE AREA INCLUDED IN THE EMERGENCY
     8  DECLARATION.
     9     Section 2.  This act shall take effect in 60 days.
