                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for the minimum
     6     number of days in a school year.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1501, act of March 10, 1949 (P.L.30,
    10  No.14), known as the "Public School Code of 1949," amended
    11  September 21, 1959 (P.L.925, No.373), is amended to read:
    12     Section 1501.  Minimum Number of Days; School Month.--All
    13  public kindergartens, elementary and secondary schools shall be
    14  kept open each school year for at least one hundred eighty (180)
    15  days of instruction for pupils. No days on which the schools are
    16  closed shall be counted as days taught, and no time shall be
    17  counted as a pupil session for any activity to which admission
    18  is charged. Unless otherwise provided by this act, the board of
    19  school directors in any district or joint board may keep such


     1  other schools or departments as it may establish open during
     2  such time as it may direct.
     3     Twenty days of actual teaching shall constitute a school
     4  month.
     5     Whenever a work stoppage or strike prevents the fulfillment
     6  of the one hundred eighty (180) day school year within the time
     7  limits of the officially adopted school calendar, the subsidy
     8  the district is entitled to shall be reduced by one-one hundred
     9  eightieth (1/180) for each day of work stoppage or of the
    10  strike, and each professional employe shall lose one-one hundred
    11  eightieth (1/180) of his salary during such time.
    12     A school district shall not keep open any school on any
    13  Saturday or on any official holiday designated by the State or
    14  on any day designated by the school district in the school
    15  calendar as a day during which the schools shall be closed, in
    16  order to make up any school day which was missed due to a work
    17  stoppage or strike.
    18     Notwithstanding any provision of law to the contrary each
    19  school district shall have completed its one hundred eighty
    20  (180) day school year no later than June 15.
    21     Section 2.  This act is amended by adding a section to read:
    22     Section 1501.1.  Adoption of School Calendar.--The Board of
    23  School Directors of every school district shall establish the
    24  official school calendar no later than June 15 for the next
    25  school year. This calendar shall set forth all the days during
    26  which the schools are to be open and all of the days the schools
    27  shall be closed. This calendar shall not be changed by the Board
    28  of School Directors.
    29     Section 3.  This act shall take effect immediately.
