                                     AN ACT

     1  Relating to the cutting and removing of certain timber and
     2     prescribing penalties.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Procedures for cutting or removing timber.
     6     Any person or persons cutting or removing timber on a
     7  commercial basis from land owned by another shall at all times
     8  have in their possession on the location of cutting and loading
     9  of such timber, written permission signed by the owner to engage
    10  in such operations. This permission shall include an accurate
    11  description of the boundaries of the cutting operation. When the
    12  owner of such property requests it be done, before the start of
    13  any such timber cutting operation, a description of the
    14  boundaries of the logging operation and such other details of
    15  the agreement as may be necessary shall be filed with the
    16  prothonotary of the county where the property is located. The
    17  prothonotary shall charge a $100 fee for such filing. All such


     1  fees shall be paid by the person or persons cutting the timber.
     2  For the purposes of this act, "person" shall not be construed to
     3  include municipal corporations, municipal authorities, public
     4  utilities, or cooperative associations providing public utility
     5  services.
     6  Section 2.  Penalty.
     7     Any person cutting or removing timber in violation of this
     8  act shall be guilty of a summary offense and shall, upon
     9  conviction, be sentenced to imprisonment for up to 90 days or to
    10  pay a fine of up to $1,000, or both.
    11  Section 3.  Effective date.
    12     This act shall take effect in 90 days.
