AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for the annual renewal of registrations 3 and drivers' licenses by the county treasurer acting as agent 4 of the department, making appropriations and repealing 5 certain provisions. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Title 75, act of November 25, 1970 (P.L.707, 9 No.230), known as the Pennsylvania Consolidated Statutes, added 10 June 17, 1976 (P.L.162, No.81), is amended by adding a section 11 to read: 12 § 1304.1. Registration by county treasurers. 13 (a) Use of fees.--The treasurer of each county shall act as 14 the agent of the department for the receiving of applications 15 and issuing registration cards and plates for the annual 16 renewals of registration of vehicles and for the collection of 17 the fees fixed by law for such renewal of registration of 18 vehicles. From the fees established by law and collected for 19 each such renewal of registration the treasurer shall retain for
1 the use of the county the sum of $1, and all such moneys are 2 hereby appropriated for such purposes. The money so received by 3 the county shall be used for paying salaries of clerical help, 4 postage, stationery and all other expenses incurred in issuing 5 such registrations and the balance thereof for the construction, 6 maintenance and repair of roads and bridges. 7 (b) Records to be kept.--The treasurer of each county shall 8 keep in his office a file or book to be furnished by the 9 department containing at all times a correct and complete record 10 of all renewal registrations issued by him and he shall at the 11 end of each week transmit to the department all such 12 applications received by him, a statement showing all 13 registrations issued by him, and the numbers assigned to each 14 applicant, all fees collected by him during such weeks, and any 15 other information and data the department may require. 16 (c) Records open to inspection.--All books, records and 17 papers of the county treasurer relating to the registration of 18 vehicles shall, at any reasonable time, be open to the 19 inspection of any officer of the Commonwealth and to any 20 representative of the department or the Department of the 21 Auditor General. 22 (d) Renewals.--Any owner of a vehicle who desires to renew 23 the registration of such vehicle as provided by law may make 24 application for such renewal of registration to the treasurer of 25 his respective county or, if the applicant is not a resident of 26 any county of the Commonwealth, then the application may be made 27 to the treasurer of the county in which such applicant may be 28 for the time being. Such application shall be made on blanks to 29 be furnished by the department and shall be in the same form as 30 now or hereafter prescribed by law. 19770H1456B1735 - 2 -
1 (e) Payment of fee, issuance of plates and cards.--At the 2 time of making such application for renewal of registration, 3 there shall be paid to the county treasurer the registration fee 4 now or hereafter fixed by law, whereupon the proper registration 5 plates and cards which shall be furnished by the department 6 shall be issued to the applicant by the treasurer. 7 Section 2. Sections 1305(a) and 1308(a) of Title 75 are 8 amended to read: 9 § 1305. Application for registration. 10 (a) General rule.--Application for the registration of a 11 vehicle shall be made either to the treasurer of the county in 12 which the applicant resides or as hereinbefore provided for 13 applicants not having a residence within the Commonwealth or to 14 the department upon the appropriate form or forms furnished by 15 the department. The application shall contain the full name and 16 address of the owner or owners; the make, model, year and 17 vehicle identification number of the vehicle; and such other 18 information as the department may require. Applicants for 19 registration of a truck, truck tractor, trailer or bus shall 20 provide the vehicle's Gross Vehicle Weight Rating (GVWR), or the 21 Gross Combination Weight Rating (GCWR), as applicable. If the 22 manufacturer's ratings are not available, the applicant shall 23 provide sufficient information as to the horsepower, braking 24 capacity and such other data as necessary for the department to 25 determine an equivalent measure of the vehicle's hauling and 26 stopping capability. If the applicant wishes to register a 27 vehicle at a registered gross weight less than the gross vehicle 28 weight rating, the application shall include information as to 29 weight, load and any other such information as the department 30 may require. 1 insurance and the applicable fee. 2 * * * 3 § 1308. Issuance of registration card. 4 (a) General rule.--The department, upon registering a 5 vehicle, or renewing a registration thereof or the county 6 treasurer acting as the agent of the department upon receiving a 7 proper application for the renewal of registration of a vehicle 8 from a person entitled thereto as herein provided, together with 9 the fee fixed by this act, shall issue to the registrant a 10 registration card which shall contain the registration number 11 assigned to the vehicle, the name and address of the registrant 12 and the name of the owner, if other than the registrant, a 13 description of the vehicle including the vehicle identification 14 number, the expiration date and such other information as may be 15 determined by the department. 16 * * * 17 Section 3. Section 1309 of Title 75 is repealed. 18 Section 4. Section 1510(a) of Title 75 is amended to read: 19 § 1510. Issuance and content of driver's license. 20 (a) General rule.--The department shall, either directly or 21 through the county treasurer as hereinafter provided upon 22 payment of the required fee, issue to every qualified applicant 23 a driver's license indicating the type or general class of 24 vehicles the licensee is authorized to drive, which license 25 shall contain a distinguishing number identifying the licensee, 26 the actual name, date of birth, residence address, a color 27 photograph of the licensee, such other information as may be 28 required by the department, and either a facsimile of the 29 signature of the licensee or a space upon which the licensee 30 shall write his usual signature with pen and ink. 1 medical data and other information for use in an emergency may 2 be included as a part of the license. Information other than 3 that required to identify the licensee, the distinguishing 4 number and the class of license issued may be included in 5 microdata form. No driver's license shall be valid until it has 6 been signed by the licensee. 7 * * * 8 Section 5. Title 75 is amended by adding a section to read: 9 § 1510.1. Issuance of drivers' licenses by counties. 10 (a) Use of fees.--The treasurer of each county shall act as 11 the agent of the department for the receiving of applications 12 and issuing drivers' license cards for the renewals of drivers' 13 licenses and for the collection of the fees fixed by law for 14 such renewals. From the fees established by law and collected 15 for each such renewal the treasurer shall retain for the use of 16 the county the sum of 50¢, and all such moneys are hereby 17 appropriated for such purposes. The money so received by the 18 county shall be used for paying salaries of clerical help, 19 postage, stationery and all other expenses incurred in issuing 20 such drivers' license cards and the balance thereof for the 21 construction, maintenance and repair of roads and bridges. 22 (b) Records to be kept.--The treasurer of each county shall 23 keep in his office a file or book to be furnished by the 24 department containing at all times a correct and complete record 25 of all renewed driver's license cards issued by him and he shall 26 at the end of each week transmit to the department all such 27 applications received by him, a statement showing all renewed 28 drivers' license cards issued by him, and the numbers assigned 29 to each applicant, all fees collected by him during such weeks, 30 and any other information and data the department may require. 19770H1456B1735 - 5 -
1 (c) Records open to inspection.--All books, records and 2 papers of the county treasurer relating to the renewal of 3 drivers' licenses shall, at any reasonable time, be open to the 4 inspection of any officer of the Commonwealth and to any 5 representative of the department or the Department of the 6 Auditor General. 7 (d) Renewal.--Any licensed driver who desires to renew his 8 driver's license as provided by law may make application for 9 such renewal to the treasurer of his respective county or, if 10 the applicant is not a resident of any county of the 11 Commonwealth, then the application may be made to the treasurer 12 of the county in which such applicant may be for the time being. 13 Such applications shall be made on blanks to be furnished by the 14 department and shall be in the same form as now or hereafter 15 prescribed by law. 16 (e) Payment of fees; issuance of cards.--At the time of 17 making such application for renewal of drivers' licenses, there 18 shall be paid to the county treasurer the fee now or hereafter 19 fixed by law, whereupon the proper cards which shall be 20 furnished by the department shall be issued to the applicants by 21 the treasurer. 22 Section 6.
