AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," limiting the increase in the tax levy
6 during any one year without a favorable referendum.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 672, act of March 10, 1949 (P.L.30,
10 No.14), known as the "Public School Code of 1949," is amended by
11 adding a subsection to read:
12 Section 672. Tax Levy; Limitations.--* * *
13 (a.1) In all school districts of the second, third and
14 fourth classes, an increase in the tax levy for any one (1) year
15 shall not exceed three (3) mills over the tax levy of the prior
16 year without first obtaining a favorable referendum on the
17 amount exceeding the three (3) mills. The referendum shall be
18 held at the same time as the primary election in the year
19 preceding the fiscal year for which the increased millage is
20 desired. The referendum shall be placed upon the ballot by the
1 school directors and the votes shall be counted and certified in
2 accordance with the provisions of the act of June 3, 1937
3 (P.L.1333, No.320), known as the "Pennsylvania Election Code."
