                                     AN ACT

     1  Amending the act of August 9, 1955 (P.L.323, No.130), entitled
     2     "An act relating to counties of the third, fourth, fifth,
     3     sixth, seventh and eighth classes; amending, revising,
     4     consolidating and changing the laws relating thereto,"
     5     providing that the salaries of elected county officers shall
     6     be set by the local salary boards and making certain repeals.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1620, act of August 9, 1955 (P.L.323,
    10  No.130), known as "The County Code," amended June 29, 1976
    11  (No.115), is amended to read:
    12     Section 1620.  Salaries and Compensation.--(a) The salaries
    13  and compensation of county officers shall be [as now or
    14  hereafter fixed by law.] fixed by the county salary board. In no
    15  event shall the salaries fixed by the salary board pursuant to
    16  this subsection be less than those salaries currently in effect
    17  as of the effective date of this amendatory act. The salaries
    18  set by the salary board shall take effect as soon as the
    19  Constitution of Pennsylvania allows.
    20     (b)  The salaries and compensation of all appointed officers

     1  and employes who are paid from the county treasury shall be
     2  fixed by the salary board created by this act for such purposes:
     3  Provided, however, That with respect to representation
     4  proceedings before the Pennsylvania Labor Relations Board or
     5  collective bargaining negotiations involving any or all employes
     6  paid from the county treasury, the board of county commissioners
     7  shall have the sole power and responsibility to represent judges
     8  of the court of common pleas, the county and all elected or
     9  appointed county officers having any employment powers over the
    10  affected employes. The exercise of such responsibilities by the
    11  county commissioners shall in no way affect the hiring,
    12  discharging and supervising rights and obligations with respect
    13  to such employes as may be vested in the judges or other county
    14  officers.
    15     Section 2.  Section 1623 of the act is amended to read:
    16     Section 1623.  Number and Compensation of Officers, Deputies,
    17  Assistants, Clerks and Employes.--The board, subject to
    18  limitations imposed by law, shall fix the compensation of all
    19  elected and appointed county officers, and the number and
    20  compensation of all deputies, assistants, clerks and other
    21  persons whose compensation is paid out of the county treasury
    22  (except employes of county officers who are paid by fees and not
    23  by salary), and of all court criers, tipstaves and other court
    24  employes, and of all officers, clerks, stenographers and
    25  employes appointed by the judges of any court and who are paid
    26  from the county treasury. Thereupon the number and compensation
    27  of all such officers, deputies, assistants, clerks and persons,
    28  whether fixed by statute or by any other method, are hereby
    29  repealed. In the event that any salary board shall fail to fix
    30  the number of compensation of any such officers, deputies,

     1  assistants, clerks or other employes as required by this
     2  section, the number and compensation shall continue, as fixed by
     3  or pursuant to law, on the effective date of this act, with like
     4  effect as though the same had been so fixed by the board, but
     5  the salary board shall have power to fix any such number or
     6  compensation, except as prohibited in section 1620(a), at a
     7  later time and with like effect.
     8     Section 3.  (a)  The act of November 1, 1971 (P.L.495,
     9  No.113), entitled "An act providing for the compensation of
    10  county officers in counties of the second through eighth
    11  classes, for the disposition of fees, for filing of bonds in
    12  certain cases and for duties of certain officers," is repealed
    13  insofar as it provides for salaries for elected county officers
    14  to the extent that such provisions are inconsistent with this
    15  act.
    16     (b)  All other acts or parts of acts inconsistent herewith
    17  are hereby repealed.
    18     Section 4.  This act shall take effect immediately.
