A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect, providing for a basis for payments of such 6 appropriations and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby specifically appropriated to the 18 Trustees of the Pennsylvania State University for the fiscal 19 year July 1, 1977 to June 30, 1978, for the purposes and in the 20 amounts as shown:
1 (1) For educational and general expenses..... $82,359,000 2 (2) For cost of student aid.................. 1,760,000 3 (3) For cost of agricultural research and 4 extension including the conservation 5 education camp........................... 15,443,000 <-- 6 14,576,000 7 (4) For cost of research..................... 7,445,000 <-- 8 7,415,000 9 (5) For instruction - Doctor of Medicine only 2,784,000 10 Section 2. Payments to Pennsylvania State University on 11 account of the appropriations for all items as provided in 12 section 1 except for instruction - Doctor of Medicine shall be 13 made on the basis of costs during the fiscal year. 14 Payments for instruction - Doctor of Medicine shall be made 15 on the basis of full-time students enrollment at the rate of 16 $7,465 per student. 17 Section 3. If necessary, the Pennsylvania State University 18 may transfer funds among the appropriations listed in section 1, 19 clauses (1), (2), (3) and (4): Provided, That the aggregate 20 amount transferred into or out of each appropriation during the 21 fiscal year shall not exceed 5% of the amount specifically 22 appropriated for that purpose. 23 Section 4. Payments to the Pennsylvania State University of 24 the appropriations herein provided shall be made monthly during 25 the fiscal year. 26 Such monthly payments shall be made in accordance with the 27 provisions of sections 2 and 3, on the basis of estimated costs 28 and full-time students enrolled in the Doctor of Medicine 29 program. The estimate of costs shall be submitted by the 30 Pennsylvania State University to the Secretary of Education, the 19770H1252B1972 - 2 -
1 General Assembly and to the State Treasurer not later than 30 2 days prior to the date on which such payment is to be made. 3 Section 5. The Pennsylvania State University shall apply the 4 moneys appropriated by this act only for such purposes as are 5 permitted in this act and shall at all times maintain proper 6 records showing the application of such moneys. Not later than 7 120 days after the close of the fiscal year to which this act 8 relates, the Pennsylvania State University shall file with the 9 Secretary of Education, the General Assembly, and with the 10 Auditor General of the Commonwealth, a statement setting forth 11 the amounts and purposes of all expenditures made from moneys 12 appropriated by this act and other university accounts during 13 said fiscal year, the number of full-time students enrolled in 14 the Doctor of Medicine program and costs, as provided in 15 sections 2 and 3, used as a basis for receipt of any 16 appropriation during said fiscal year. 17 Such statement of expenditures and number of full-time 18 students enrolled in the Doctor of Medicine program and costs 19 shall be reviewed by the Auditor General of the Commonwealth, 20 and he shall have the right, in respect to the moneys 21 appropriated by this act, to audit and disallow expenditures 22 made for purposes not permitted by this act and to cause such 23 sums to be recovered and paid by the Pennsylvania State 24 University to the Treasurer of the Commonwealth. The Auditor 25 General shall also make a determination of full-time students 26 enrolled in the Doctor of Medicine program and costs and make a 27 certification as to their correctness. In respect to 28 expenditures made by the university from moneys other than those 29 appropriated by this act, the Auditor General shall have the 30 right to review only and he shall file annually with the General 19770H1252B1972 - 3 -
1 Assembly such information concerning such expenditures as the 2 General Assembly or any of its committees may require. 3 Section 6. A report shall be submitted to the Governor, the <-- 4 Secretary of Education and the Appropriations and Education 5 Committees of the Senate and House of Representatives and shall 6 include data for all programs of the university except the 7 Doctor of Medicine program. The report, to be submitted prior to 8 October 1, 1977, shall cover the twelve-month period beginning 9 July 1, 1976 and ending June 30, 1977. The report shall 10 include: 11 (1) For each term during the period, the following counts 12 and distributions: 13 (i) The definitions and numbers of full-time faculty 14 members, of part-time faculty members, of full-time graduate 15 students, of part-time graduate students, of full-time 16 undergraduate students, and of part-time undergraduate students. 17 (ii) A distribution of part-time faculty members by the 18 percentage of full-time employment. 19 (iii) Definitions of course levels of instruction and the 20 number of different courses scheduled by course level, 21 distributed by the number of sections scheduled in each course 22 and the sections distributed by the number of students enrolled 23 in each section. 24 (iv) Number of terms scheduled and the dates thereof. 25 (2) For the twelve-month period, the following, distributed 26 by student level: lower division undergraduate, upper division 27 undergraduate, graduate, and first professional (excluding 28 Doctor of Medicine) within HEGIS discipline division (as defined 29 by "A Taxonomy of Instructional Programs in Higher Education," 30 U. 1 Education, 1970): 2 (i) The number of equivalent full-time students (EFTS) 3 taught. 4 (A) EFTS taught by HEGIS discipline will be determined from 5 production student credit hours (student credit hours produced 6 by an academic department, regardless of the student majors 7 taking the courses). 8 (B) EFTS taught by student level within HEGIS discipline 9 divisions will be determined by the level of the students taking 10 the courses, regardless of the course level of instruction of 11 the courses being taken. 12 (ii) Teaching salaries per equivalent full-time student. 13 (A) Teaching salaries will be distributed by student level 14 based on course credits taught, with equal weight given to all 15 course levels of instruction. 16 (B) In distributing teaching salaries, each thirty student 17 credit hours of thesis or dissertation work equals one three- 18 credit section. 19 (C) In distributing teaching salaries, all students engaged 20 in independent study who are assigned to one faculty member will 21 be considered one three-credit section. 22 (D) Teaching salaries will be distributed by student level 23 only for those individuals budgeted for instruction as reflected 24 in Part III, "Instruction and Departmental Research," 25 Commonwealth of Pennsylvania Budget Instructions for State- 26 Related Universities, Phase I, Fiscal Year 1978-1979. 27 (iii) Total costs per equivalent full-time student. 28 (A) Direct costs other than teaching salaries will be 29 allocated by student level within HEGIS discipline division 30 based on institutional records. 19770H1252B1972 - 5 -
1 (B) Indirect costs of instruction will be prorated to each 2 student level within HEGIS discipline division as a percentage 3 of direct costs. An exception will be major organized activities 4 (e.g., university farm operations, dental clinics). These 5 activities will be allocated directly to the related HEGIS 6 discipline group. 7 (iv) Costs to the Commonwealth per equivalent full-time 8 student. 9 (A) Total costs will be offset by income for instruction to 10 determine costs to the Commonwealth. 11 (B) Income for instruction derived from student tuition will 12 be allocated by HEGIS discipline and by student level based on 13 the number of equivalent full-time students and the specific 14 tuition rates for that level. 15 (C) Income for instruction derived from other sources and 16 related to a specific HEGIS discipline group will be allocated 17 directly to that group. 18 (D) Income for instruction derived from other sources and 19 not related to a specific HEGIS discipline group will be 20 allocated as a percentage of student tuition income. 21 (v) Totals by student level for all HEGIS discipline 22 divisions combined for: 23 (A) The number of equivalent full-time students taught. 24 (B) Teaching salaries per equivalent full-time student. 25 (C) Total costs per equivalent full-time student. 26 (D) Costs to the Commonwealth per equivalent full-time 27 student. 28 These totals must agree with the corresponding totals in Part 29 III, "Instruction and Departmental Research," Commonwealth of 30 Pennsylvania Budget Instructions for State-Related Universities, 19770H1252B1972 - 6 -
1 Phase I, Fiscal year 1978-1979. 2 (vi) All program data will be compiled from institutional 3 records. Program data are required for each HEGIS discipline in 4 which the institution offers instructional programs (excluding 5 Doctor of Medicine Program). Unless otherwise specifically 6 stated, the conventions and procedures will be the same as those 7 specified in the Commonwealth of Pennsylvania Budget 8 Instructions for State-Related Universities, Phase I, Fiscal 9 Year 1978-1979. 10 Section 7. In addition to the requirements of section 6, the 11 report covering the twelve-month period beginning July 1, 1976 12 and ending June 30, 1977, shall include for all programs of the 13 university, except the Doctor of Medicine program: 14 (1) Minimum number of credits required for a baccalaureate 15 degree, and for a master's degree. 16 (2) Number of associate degrees, baccalaureate degrees, 17 master's degrees, first-professional degrees, and doctoral 18 degrees awarded by HEGIS discipline divisions, for 1975-1976, 19 1976-1977 and projected for 1977-1978. 20 (3) A listing of the academic departments and instructional 21 subject matter in each of the HEGIS discipline divisions 22 included in the report specified in section 6. 23 SECTION 6. A REPORT SHALL BE SUBMITTED TO THE GOVERNOR AND <-- 24 THE APPROPRIATIONS AND EDUCATION COMMITTEES OF THE SENATE AND 25 HOUSE OF REPRESENTATIVES AND SHALL INCLUDE DATA FOR ALL PROGRAMS 26 EXCEPT THE DOCTOR OF MEDICINE PROGRAM. EACH SUCH REPORT, TO BE 27 SUBMITTED PRIOR TO NOVEMBER 1, 1978, SHALL COVER THE 12-MONTH 28 PERIOD BEGINNING SEPTEMBER 1, 1977 AND SHALL INCLUDE FOR EACH 29 TERM DURING THE PERIOD: 30 (1) THE FOLLOWING COUNTS AND DISTRIBUTIONS: 19770H1252B1972 - 7 -
1 (I) THE DEFINITIONS AND NUMBERS OF FULL-TIME FACULTY 2 MEMBERS, OF PART-TIME FACULTY MEMBERS, OF FULL-TIME 3 STUDENTS ENROLLED IN GRADUATE COURSES, OF FULL-TIME 4 STUDENTS ENROLLED IN UNDERGRADUATE COURSES, OF PART-TIME 5 STUDENTS ENROLLED IN GRADUATE COURSES, AND OF PART-TIME 6 STUDENTS ENROLLED IN UNDERGRADUATE COURSES. 7 (II) A DISTRIBUTION OF PART-TIME FACULTY MEMBERS BY 8 THE PERCENTAGE OF FULL-TIME EMPLOYMENT. 9 (III) TOTAL NUMBERS OF UNDERGRADUATE STUDENT CREDIT 10 HOURS, DIVIDED INTO LOWER DIVISION AND UPPER DIVISION 11 LEVELS, AND OF GRADUATE STUDENT CREDIT HOURS DIVIDED INTO 12 THREE LEVELS--MASTER'S, FIRST PROFESSIONAL AND DOCTORAL. 13 (IV) NUMBER OF DIFFERENT COURSES SCHEDULED BY LEVEL 14 OF INSTRUCTION, DISTRIBUTED BY THE NUMBER OF SECTIONS 15 SCHEDULED IN EACH COURSE AND THE SECTIONS DISTRIBUTED BY 16 THE NUMBER OF STUDENTS ENROLLED IN EACH SECTION. 17 (V) NUMBER OF TERMS SCHEDULED AND THE DATES THEREOF. 18 (2) A CLASSIFICATION OF FACULTY MEMBERS OR OTHER 19 PROFESSIONAL EMPLOYEES BY TITLE INCLUDING: PROFESSOR, 20 ASSOCIATE PROFESSOR, ASSISTANT PROFESSOR, INSTRUCTOR, 21 LECTURER, RESEARCH ASSOCIATE, LIBRARIAN, AND ACADEMIC 22 ADMINISTRATOR; FACULTY MEMBERS OR OTHER PROFESSIONAL 23 EMPLOYEES UNDER EACH TITLE TO BE SUBDIVIDED BY TYPE OF 24 ASSIGNMENT: UNDERGRADUATE COURSES ONLY, GRADUATE COURSES 25 ONLY, OR BOTH GRADUATE AND UNDERGRADUATE COURSES; AND EACH 26 SUCH SET OF FACULTY MEMBERS OR OTHER PROFESSIONAL EMPLOYEES 27 TO BE FURTHER SUBDIVIDED BY TYPE OF EMPLOYMENT: FULL-TIME OR 28 PART-TIME; AND THE FOLLOWING AGGREGATES FOR EACH SUCH 29 SUBDIVIDED CLASSIFICATION: 30 (I) THE NUMBER. 19770H1252B1972 - 8 -
1 (II) THE SUM OF CREDITS ASSIGNED TO UNDERGRADUATE 2 COURSES AND THE SUM OF CREDITS ASSIGNED TO GRADUATE 3 COURSES TAUGHT, DIVIDED INTO LOWER DIVISION, UPPER 4 DIVISION, MASTER'S, FIRST PROFESSIONAL AND DOCTORAL 5 LEVELS. 6 (III) THE SUM OF UNDERGRADUATE STUDENT CREDIT HOURS 7 AND THE SUM OF GRADUATE STUDENT CREDIT HOURS GENERATED; 8 DIVIDED INTO LOWER DIVISION, UPPER DIVISION, MASTER'S, 9 FIRST PROFESSIONAL AND DOCTORAL LEVELS. 10 (IV) TOTAL SALARY PAID. 11 (V) TOTAL SALARY PAID FROM COLLEGE OR UNIVERSITY 12 FUNDS. 13 (VI) TOTAL SALARY PAID FROM FEDERAL FUNDS. 14 (VII) TOTAL SALARY PAID FROM OTHER FUNDS. 15 (3) FOR EACH TERM OF THE PERIOD COVERED FOR EACH FULL- 16 TIME FACULTY MEMBER IDENTIFIED BY SCHOOL, DEPARTMENT AND 17 TITLE: 18 (I) AN ANALYSIS OF THE AVERAGE HOURS PER WEEK SPENT 19 IN COLLEGE OR UNIVERSITY-RELATED ACTIVITIES, STATING 20 SPECIFICALLY HOURS SPENT IN UNDERGRADUATE CLASSROOM 21 CONTACT AND GRADUATE CLASSROOM CONTACT, HOURS SPENT IN 22 PREPARATION, HOURS SPENT IN RESEARCH AND HOURS SPENT IN 23 PUBLIC SERVICE. 24 (II) THE TOTAL SALARY PAID AND THE SALARY PAID FROM 25 COLLEGE OR UNIVERSITY FUNDS. 26 IN ADDITION TO THE ABOVE REQUIREMENTS RELATIVE TO THIS 27 APPROPRIATION, EACH REPORT COVERING THE 12-MONTH PERIOD 28 BEGINNING SEPTEMBER 1, 1977, SHALL INCLUDE FOR ALL PROGRAMS OF 29 THE STATE COLLEGES OR STATE-OWNED UNIVERSITY: 30 (1) MINIMUM NUMBER OF CREDITS REQUIRED FOR A 19770H1252B1972 - 9 -
1 BACCALAUREATE DEGREE AND FOR A MASTER'S DEGREE. 2 (2) NUMBER OF BACHELOR'S DEGREES, MASTER'S DEGREES, 3 FIRST PROFESSIONAL DEGREES, AND DOCTORAL DEGREES AWARDED IN 4 1975, 1976, 1977 AND ESTIMATED 1978. 5 THE STATE COLLEGES AND STATE-OWNED UNIVERSITY SHALL REPORT 6 THEIR REVENUES AND EXPENDITURES AND PRESENT THEIR FINANCIAL 7 STATEMENTS REQUIRED UNDER THE PROVISIONS OF THIS ACT IN 8 ACCORDANCE WITH HIGHER EDUCATION FINANCE MANUAL (1975). 9 Section 8. 7. The university shall provide such information <-- 10 and in such form and manner as the Department of Education may 11 prescribe. 12 Section 9. 8. The Pennsylvania State University shall report <-- 13 its revenues and expenditures and present its financial 14 statements required under the provisions of this act in 15 accordance with generally accepted accounting principles and 16 procedures for educational institutions as set forth in "Higher 17 Education Finance Manual" United States Department of Health, 18 Education and Welfare (1975) with the exceptions set forth in 19 the Commonwealth of Pennsylvania Budget Instructions for State 20 Related Universities, Phase I, Fiscal Year 1977-1978. Credits 21 granted for non-traditional programs such as CLEP, lifelong 22 learning etc., including all related costs and revenues thereof 23 shall be excluded from the function of "Instruction" and 24 included under "Public Service." 25 Section 10. 9.
