AN ACT 1 Amending the act of June 24, 1931 (P.L.1206, No.331), entitled 2 "An act concerning townships of the first class; amending, 3 revising, consolidating, and changing the law relating 4 thereto," providing for special building permit fees and 5 disposition thereof to certain volunteer fire companies. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Clause XVIII of section 1502, act of June 24, 9 1931 (P.L.1206, No.331), known as "The First Class Township 10 Code," reenacted and amended May 27, 1949 (P.L.1955, No.569) and 11 amended July 31, 1963 (P.L.384, No.204), is amended to read: 12 Section 1502. The corporate power of a township of the first 13 class shall be vested in the board of township commissioners. 14 The board shall have power-- 15 * * * 16 XVIII. Building and Housing Regulations.--To prohibit or 17 regulate the erection of wooden buildings and housing in certain 18 parts of the township and make regulations for the construction 19 of new buildings and housing and the alteration and repair of
1 old ones, and to require that before the work begins municipal 2 approval of the plans and specifications therefor be secured; to 3 classify buildings and housing or parts of buildings and housing 4 according to the use to be made of them; to specify the mode of 5 construction of such different classes of buildings and housing; 6 and to require that before any use or occupancy be changed from 7 any classification to a different classification, as to which 8 more stringent regulations are prescribed under the provisions 9 of any ordinance relating thereto, municipal approval of the 10 plans and specifications therefor be secured. The ordinance or 11 resolution regulating the same shall provide for a special 12 building permit fee for each new dwelling unit of fifty dollars 13 per dwelling, apartment or comparable non-residential unit, 14 which amount shall be paid to the volunteer fire company 15 providing primary fire protection to the building or unit 16 thereof for which the permit is issued. No such special building 17 permit shall be required for alterations, repairs or 18 improvements to existing dwellings unless they result in a new 19 dwelling unit. 20 * * * 21 Section 2.
