        AS REPORTED FROM COMMITTEE ON BUSINESS AND COMMERCE, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 22, 1977

                                     AN ACT

     1  Amending the act of December 27, 1951 (P.L.1793, No.475),
     2     entitled "An act providing for the marking of liquefied
     3     petroleum gas containers and prohibiting the refilling or use
     4     of such containers without authorization by the owner
     5     thereof; authorizing the Department of Labor and Industry,
     6     after public hearing, to prescribe uniform regulations for
     7     safety in the design, construction, location, installation
     8     and operation of equipment for storing, handling,
     9     transporting by tank truck or tank trailer and utilizing
    10     liquefied petroleum gases for fuel purposes and for the
    11     odorization of said gases used therewith; prohibiting the
    12     adoption by municipalities or other political subdivisions of
    13     ordinances or regulations in conflict with this act;
    14     providing for prosecutions for violations of this act by
    15     summary proceedings, and prescribing the penalty therefor,"
    16     further providing for dealer registration.

    17     The General Assembly of the Commonwealth of Pennsylvania
    18  hereby enacts as follows:
    19     Section 1.  Section 3.2, act of December 27, 1951 (P.L.1793,
    20  No.475), referred to as the Liquefied Petroleum Gas Act, added
    21  July 29, 1953 (P.L.1028, No.267) and amended August 11, 1959
    22  (P.L.679, No.225), is amended to read:
    23     Section 3.2.  No registration certificate shall be issued
    24  until an annual registration fee shall have been paid to the


     1  department.
     2     (a)  In the case of bulk plants having the following storage
     3  facilities, the fees shall be as follows:
     4     (1)  30,000 gallons or less..........................  $50.00
     5     (2)  30,001 to 90,000 gallons.......................    75.00
     6     (3)  90,001 gallons or more..........................  100.00
     7     (b)  In the case of industrial and utility users having the
     8  following storage facilities, the fees shall be as follows:
     9     (1)  2001 to 30,000 gallons..........................  $25.00
    10     (2)  30,001 to 180,000 gallons.......................   50.00
    11     (3)  180,001 or more gallons.........................  100.00
    12     (c)  In the case of dealers, the fees shall be as follows:
    13     (1)  Dealers having less than 1000 customers...........$62.50
    14     (2)  Dealers having 1000 customers
    15          and less than 3000 customers....................  125.00
    16     (3)  Dealers having 3000 customers and less than
    17          6000 customers..................................  187.50
    18     (4)  Dealers having 6000 or more customers...........  250.00
    19     (d)  A person desiring to act as a dealer need register only
    20  in the dealer class, subsection (c), and not in the bulk plant
    21  class, subsection (a), provided that any storage facilities are
    22  maintained only in connection with the dealership and not in
    23  connection with a bulk plant operation separate from the
    24  dealership. THE DEALER SHALL SERVE ONLY THOSE CUSTOMERS IN HIS    <--
    25  IMMEDIATE AREA.
    26     Section 2.  This act shall take effect immediately.
