                                     AN ACT

     1  Amending the act of October 10, 1974 (P.L.705, No.235), entitled
     2     "An act providing for the training and licensing of watch
     3     guards, protective patrolmen, detectives and criminal
     4     investigators, carrying and using lethal weapons in their
     5     employment; imposing powers and duties on the Commissioner of
     6     the Pennsylvania State Police; and providing penalties,"
     7     providing for certification of certain privately employed
     8     agents.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Subsection (b) of section 4, act of October 10,
    12  1974 (P.L.705, No.235), known as the "Lethal Weapons Training
    13  Act," amended November 23, 1976 (No.254), is amended to read:
    14     Section 4.  Education and Training Program.--* * *
    15     (b)  [All] Except as otherwise provided herein, all privately
    16  employed agents, except those who have been granted a waiver
    17  from compliance herewith by the commissioner who, as an
    18  incidence to their employment, carry a lethal weapon shall be
    19  required to attend the program established by subsection (a) of
    20  this section in accordance with the requirements or regulations
    21  established by the commissioner and, upon satisfactory


     1  completion of such program, shall be entitled to certification
     2  by the commissioner. Persons employed before January 1, 1976 as
     3  privately employed agents and who have been instructed in the
     4  use of lethal weapons by a superior who has served as a police
     5  officer or who themselves have served as a police officer shall
     6  be entitled to certification by the commissioner.
